As used in this chapter, the following terms shall have the
meanings indicated:
FENCE
An enclosed barrier consisting of wood, stone or metal intended
to prevent ingress or egress.
Fences six feet or less in height are permitted adjacent to
rear and side lot lines. Residential fences less than or equal to
four feet in height are permitted in the street yard setback area
but shall not be closer than two feet to any public right-of-way.
All fences must be constructed and maintained in a good state of repair
and appearance.
No fence shall be erected, placed, maintained or grown along
a lot line on any non-residentially zoned property, adjacent to a
residentially zoned property, to a height exceeding eight feet.
Fences in or adjacent to a residential property shall have a
minimum one-foot side and rear yard setback, except as the adjoining
property owners may otherwise agree in writing as a part of the application
for a permit. Fences shall be constructed alongside lot lines but
must be so placed to allow the fence owner to maintain both sides
of the fence, on his or her property. The fence owner shall properly
trim weeds and grasses around the fence.
No fence shall be constructed which is in a dangerous condition,
or which conducts electricity or is designed to electrically shock
or which uses barbed wire; provided, however, that barbed wire may
be used in industrially zoned areas if the devices securing the barbed
wire to the fence are eight feet above the ground or height and project
toward the fenced property and away from any public area.
All fences shall be maintained and kept safe and in a state
of good repair, and the finished side or decorative side of a fence
shall face adjoining property.
Fences erected for the protection of planting or to warn of
construction hazard, or for similar purposes, shall be clearly visible
or marked with colored streamers or other such warning devices at
four-foot intervals. Such fences shall comply with the setback requirements
set forth in this chapter. The issuance of a permit shall not be necessary
for temporary fences as described herein, but said fences shall not
be erected for more than 45 days.
Any fence existing on the effective date of this chapter and
not in conformance with this chapter may be maintained, but any alteration,
modification or improvement of said fence shall comply with this chapter.
No person shall erect a fence unless a permit is first obtained
by the owner or his or her agent from the Village, unless the fence
is exempt from permit. The applicant shall submit design specifications
for approval and pay required permit fees at the time of making application.
Fences shall be erected on the owner's property and responsibility
for establishing the property line shall rest with the property owner
erecting the fence.
Snow fences may be used only during the winter months and shall
be removed at the end of each winter season.
