The sanitary sewer system within the Borough of Wanaque is experiencing surcharge problems which have caused an increase in the gallonage added to the sewer system by sump pumps which are improperly connected to the Borough sewer system. It is in the best interest of the Borough of Wanaque to establish a program to cause the removal of the improperly connected sump pumps.
No person, firm, organization, association, partnership or corporation shall install or make connection to the sanitary sewer system of the Borough of Wanaque without first obtaining a permit to do so from the Borough of Wanaque.
No person, firm, organization, association, partnership or corporation shall discharge stream, storm-, roof, surface or subsurface water into the sanitary sewer system of the Borough of Wanaque.
An owner or occupant of any real property having connection to the sanitary sewer system of the Borough of Wanaque by virtue of which stream, storm-, roof, surface or subsurface water is discharged into the sanitary sewer system of the Borough of Wanaque shall remove said connection or take necessary corrective action to prevent the discharge of stream, storm-, roof, surface or subsurface water into the said system within 60 days from the effective date of this article.
Any person, firm, organization, association, partnership or corporation who shall violate any provision of this article or fail to comply therewith shall severally, for each and every such violation and noncompliance, forfeit and pay a penalty not to exceed the sum of $500 or be subject to imprisonment in jail for a period of not more than 90 days, at the discretion of the court or jurisdictional officer before whom a conviction may be found. The imposition of the foregoing penalty shall not bar the right of the governing body to specifically enforce the provisions of this article.
