The Water and Sewer Utility will accept industrial wastes into
the sanitary sewerage system upon execution of a formal, written agreement
and under and subject to the provisions appearing in said agreement
and the rules stated hereinafter. The agreement will set out in detail
the characteristics of the wastes, the flow conditions which shall
govern, the conditions and costs with respect to the physical connection
or connections and the annual service charges. It will be the policy
of the Utility to consider each application on its merits and to establish
specific conditions applicable to the particular situation for each
agreement. No connection shall be made prior to execution of the formal
agreement. Each said agreement shall have stipulated time limits for
connection, after which it shall become null and void at the discretion
of the Utility. All connections must have the written approval, if
applicable, of the Gloucester County Utilities Authority and the New
Jersey Department of Environmental Protection.
The application and supporting data specifying the engineering
details of the proposed project will be analyzed for compliance with
Water and Sewer Utility engineering standards, including the provision
for orderly growth. The final condition of approval will be a mutual
agreement between the applicant and the Borough regarding the terms
and conditions for providing sewer service.
The application and supporting data will be reviewed by the
Water and Sewer Utility Superintendent, in consultation with the Utility
Engineer. If it is determined that it is feasible to extend service
and that the plans are in compliance with Utility technical standards,
the applicant will be notified of the Utility approval and the connection
fee. Upon receipt of said connection fee, the sewer permits will be
issued to the applicant and to the Building Inspector.
Should the applicant fail to tie in or connect to the sanitary
sewerage system within the time period specified in the agreement
or if not specified in the agreement within two years of the issuance
of a permit, the Utility reserves the right to inform the applicant,
in writing, that the permit will be considered void within 30 days
of said notice. If the applicant fails to complete the connection
within said thirty-day period, the Utility shall notify the applicant
that the permit is void and shall return the appropriate fees.
Industrial establishments permitted to connect to Utility sewer
facilities, even though initially being required to provide preliminary
treatment, may be required to provide a control manhole and/or meter
and sampler.
In the event that any industrial establishment fails to conform
to these rules and regulations or fails to comply with the terms and
conditions of its formal agreement with the Borough, which failure
causes damage of any sort to Utility equipment and facilities or to
Borough employees, the Utility shall determine the extent of the damage
and bill the industrial establishment accordingly. If said bill is
not paid within 10 calendar days from the date of receipt, appropriate
legal action shall be instituted to enforce recovery of said damages,
and the Utility shall terminate the connection after giving 24 hours'
notice. The Utility reserves the right to cancel a service agreement
upon three months' written notice in the event of recurrent failure
to comply with the terms of said agreement.
Where the industrial establishment provides its own water supply
entirely separate from that supplied by the Borough or provides from
its own sources a portion of the water consumed on the premises which
eventually finds its way into the sanitary sewerage system, the provisions
of the schedule of rates will apply. This does not relieve the industrial establishment of the requirement to furnish, install and maintain a flow meter of the indicator-register-recorder type to measure the discharge of industrial wastes and a wastewater sampler to periodically take and preserve a portion of the wastewater stream, as described in §
78-67. The flow meter and wastewater sampler shall be approved by the Utility prior to installation but supplied by the customer. All costs of furnishing, installing and maintaining the industrial waste flow and sampling equipment will be borne by the industrial establishment, and it shall be readily accessible to Utility personnel.
The industrial wastewater parameters and the criteria for industrial
waste limits are subject to future revision or modification as may
be required by law or the regulations of the New Jersey Department
of Environmental Protection, United States Environmental Protection
Agency, Gloucester County Utilities Authority, Delaware River Basin
Commission and Borough of Clayton Water and Sewer Utility.
