GENERAL REFERENCES
Fire prevention — See Ch. 111.
For the purpose of this chapter the following terms shall have the following meanings:
COMBUSTIBLE FUELS
Firewood, lumber, pellets, coal, oil, gas, corn.
EMISSIONS
Any air contaminants that are released into the outdoor atmosphere.
LUMBER and/or FIREWOOD
Any natural, dried wood not treated with chemicals or petroleum, stains, paints, glues or any other unnatural characteristics.
OUTDOOR BOILER/FURNACE
Any equipment exterior to a building designed and constructed to utilize combustible materials to produce a heating medium for the purposes of providing space heating to a structure other than its own by the use of combustible fuels.
An outdoor boiler/furnace installation and use permit is required and is subject to the provisions of § 112-3 of this chapter. In addition, regulations promulgated by all other federal, state or other regional agencies, where applicable, shall apply. In the case of conflict, the more restrictive provision shall apply.
Permitted uses:
A. 
Use of outdoor boilers/furnaces is permitted in all zoning districts as shown on the Town Zoning Map.
B. 
The outdoor boiler/furnace shall be equal to the existing setbacks in the Town Zoning Law[1] for residents.

C. 
No heating equipment shall extend beyond the front of the principal building.
D. 
The outdoor boiler/furnace shall not be used as a refuse or waste incinerator.
E. 
Emission stacks shall be a minimum of 16 feet high.
F. 
Emission stacks shall be equipped with spark arrestors.
G. 
No emissions from any outside boiler shall produce an average opacity during any six consecutive minutes of 20% or greater.
H. 
Wiring must be inspected and approved by a certified/approved electrical inspector.
I. 
An outdoor boiler/furnace shall only be operated between September 1 and May 31.
A. 
This chapter shall be enforced by the Town Building Inspector, Fire Inspector, or other authorized individual (hereinafter collectively referred to as the "Enforcement Officer"). Said Building Inspector shall be authorized and shall have the right in the performance of his duties to enter upon any property on which an outdoor boiler/furnace is located to make such inspections as are necessary to determine satisfactory compliance with the provisions of this chapter. Such entrance and inspection shall be initiated at reasonable times and upon reasonable notice, and in emergencies whenever necessary to protect the public interest, but shall be limited to those parts of the premises on which an outdoor boiler/furnace is located. It shall be the duty of the Building Inspector to investigate all complaints made under this chapter and to take appropriate legal action on all violations of this chapter. Use of improper fuel and excessive smoke emissions shall be grounds for investigation and inspection.
B. 
If the Building Inspector determines that there has been a violation of any provision of this chapter, he shall serve upon the property owner an initial order, in writing, to cease and desist immediately and direction that conditions therein specified be corrected within five working days after the serving of such order. The order shall also contain an outline of remedial action that, if taken, will effect compliance. Such order and notice shall be served upon a person to whom it is directed either by delivering it to him personally or by posting the same upon a conspicuous portion of the areas involved and sending a copy of the same by certified mail, return receipt requested.
C. 
If, after the expiration of the period specified in Subsection B of this section, such conditions are not corrected, the Building Inspector shall serve a notice in writing upon such owner requiring him to cease operations and to appear before the Town Justice of the Town of Greenville at a time to be specified in such notice, which time shall not be less than 48 hours after service of such notice.
D. 
A violation of any provision of this chapter shall be punishable by a fine of no less than $100 nor more than $1,000, and/or up to 30 days in jail. Each day a violation continues shall be a separate violation. In addition, a civil penalty may be imposed for the cost of correcting any violation or damage caused by the operation of the outdoor boiler/furnace.
