The purpose of this chapter shall be to supersede
Local Law No. 4 of the year 1997 in order to increase the membership
of the Planning Board of the Town of Greenville from five to seven;
to designate length of terms; and to enable the Planning Board to
continue exercising all of the powers granted to it pursuant to Article
16 of the Town Law.
All local laws or parts of local laws of the
Town of Greenville or any previous resolution of the Town Board of
the Town of Greenville in conflict with the provisions of this chapter
are hereby repealed.
The Planning Board of the Town of Greenville
shall consist of seven members.

A. Term of
Planning Board members. The Town Board of the Town of Greenville has
elected to supersede the New York State Town Law pursuant to the Municipal
Home Rule Law of the State of New York and the Town Board has determined
that all future appointments to the Planning Board shall be for a
term of three years from the date of appointment by the Town Board.

B. Appointment.
The Town Board shall supersede the New York State Town Law pursuant
to the Municipal Home Rule Law and may, during the annual reorganization
meeting of the Town Board, or as soon thereafter as practicable, appoint
an alternate member or members of the Planning Board to serve for
a term of one year or until a successor is appointed. Such alternate
members shall attend meetings and act in the capacity of a full member
whenever regular members cannot attend or must recuse themselves due
to conflicts of interest. Alternate members shall not participate
in the Board's deliberation of any matter in which they are not called
upon to act in replacement of a regular member.
The Planning Board shall have the power and
authority to employ experts, clerks and a secretary and to pay for
their service and to provide for such other expenses as may be necessary
and proper, not exceeding in all the appropriation that may be made
therefor by the Town Board for the Planning Board.
The Planning Board may review and make recommendations
on a proposed Town Comprehensive Plan or amendment thereto. In addition,
the Planning Board shall have full power and authority to make investigations,
maps, reports and recommendations in connection therewith relating
to the planning and development of the Town of Greenville as it seems
desirable, provided that the total expenditures of the Planning Board
shall not exceed the appropriation provided therefor.
The Planning Board may recommend to the Town
Board regulations relating to any subject matter over which the Planning
Board has jurisdiction under Article 16 of the Town Law or any other
statute or under any local law or ordinance of the Town of Greenville.
The Planning Board shall have full authority
and power to exercise all functions granted to it by Article 16 of
the Town Law, as amended, including but not limited to site plan review,
approval of special use permits and approval of preliminary and final
subdivision plats.
This chapter is hereby adopted pursuant to the
Municipal Home Rule Law and § 271 of the Town Law.
