Borough of Seaside Park, NJ Handicapped Parking

Whenever any words or phrases are used in this Part 6, the meanings respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of New Jersey shall be deemed to apply to such words as used herein.

§ 435-54 Authority to designate parking spaces; criteria.

Pursuant to the authority granted by N.J.S.A. 39:4-197.5, the Borough of Seaside Park may establish restricted parking spaces in front of residences, schools, hospitals, and other public buildings and in shopping and business districts for use by persons who have been issued special vehicle identification cards by the Motor Vehicle Commission or any other agency so designated by the State of New Jersey.

Pursuant to the authority granted by N.J.S.A. 39:4-197.6, the Borough of Seaside Park may establish restricted parking spaces in front of a residence occupied by a handicapped person if a windshield placard or wheelchair symbol license plates have been issued for a vehicle owned by the handicapped person, or by another occupant of the residence who is a member of the immediate family of the handicapped person, by the Motor Vehicle Commission or other agency so designated by the State of New Jersey. Upon completion and approval of an application set forth in § 435-59, the Borough of Seaside Park shall issue a permit 5 1/2 inches by 8 1/2 inches in size, bearing this Borough of Seaside Park's certification of authenticity along with a description identifying both the specific motor vehicle and the location wherein it is to be parked. Said permit shall be displayed prominently within the vehicle when it is parked so as to be seen from the middle of the street. The Borough of Seaside Park shall also issue and install signage in accordance with § 435-56 identifying the restricted parking space.

In lieu of a restricted parking space pursuant to Subsection B, a person meeting the criteria for a restricted parking space as approved by the Chief of Police may make application to the Construction Official for an expansion of an existing curb cut in the immediate surrounding area. Upon approval of the Chief of Police, the Construction Official shall issue an initial decision subject to the review and approval of the governing body. Upon approval by resolution, the Construction Official shall issue a final permit allowing the expansion of the existing curb cut. The applicant shall bear all costs and liabilities for retaining a contractor, and the performance of the work. All work must be performed and completed pursuant to the construction code.

Criteria. Applicants requesting placement of a restricted parking space pursuant to Subsection B in front of their home or residence shall generally be eligible only if the home or residence is not serviced by a driveway and the permitting thereof does not interfere with the normal flow of traffic. The governing body retains the discretion to grant restricted handicapped parking spaces where the home or residence is serviced by a driveway in appropriate cases where compelling reasons are present.

Any person(s) or family member issued a permit hereinabove pursuant to Subsection B shall immediately notify the Borough of Seaside Park Police Department, upon a change of circumstances that necessitates the revocation of said permit, including but not limited to death or relocation of the handicapped person(s).

§ 435-55.1 Restricted parking spaces for handicapped persons designated for public use.

In accordance with the provisions of § 435-54A, the following described locations are hereby designated as restricted public parking spaces for use by persons who have been issued special vehicle identification cards by the Division of Motor Vehicles:

§ 435-56 Signs to be erected.

Upon the adoption of § 435-52, Subsection B, proper signs calling attention to provisions of § 435-54, Subsection B, shall be erected or placed upon the hereinabove described portions of streets.

§ 435-57 Violations and penalties.

Any person parking a motor vehicle in a restricted parking space without a special vehicle identification card and permit in locations set forth in § 435-55 shall be liable to the general penalty in Chapter 1, Article II, General Penalty, of the Borough Code with a minimum fine of $250.

§ 435-58 When effective.

This Part 6 shall take effect upon its final passage and publication as required by law and upon approval thereof by the Commissioner of Transportation.

§ 435-59 Application; fee; annual renewal.

Pursuant to N.J.S.A. 39:4-197.7, all persons requesting a restricted parking space shall file an application with the Chief of Police of the Borough of Seaside Park, setting forth the following information:

(1)

Applicant's name, telephone number and address.

(2)

Applicant's driver's license or state identification card issued to the address of applicant.

(3)

Vehicle registration issued to the address of the applicant or household member for which the restricted parking is requested.

(4)

A Valid Special Vehicle Identification Card.

(5)

Description of the location where the restricted parking is requested.

All persons who have requested a restricted parking space permit pursuant to § 435-54, Subsection B, will be required to pay an application and installation fee. All those residences formally designated prior to these ordinances will be grandfathered and will not be required to pay the initial application and installation fee for the first year. Any applicant who has applied prior to the effective date of this chapter shall pay the installation fee but shall not have to pay the application fee. All other persons shall be required to pay the application and installation fee.

(a)

Application and posting fee: $25.

Annual renewal: All persons who have requested and obtained a restricted parking space and permit in accordance with § 435-54B must apply every year to the Chief of Police of the Borough of Seaside Park for a renewal of the restricted parking space by January 31. A condition of renewal will be that the person(s) making the request must show continued possession of a valid special vehicle identification card issued by the Motor Vehicle Commission or by any other agency so designated by the State of New Jersey.
