The purpose of this article is to establish permit fees, rules,
regulations and procedures for beach fires or beach parties having
open fires. A "beach fire" is defined as the burning of any combustible
material on the beaches within Seaside Park. Permissible materials
for burning are hereinafter described and enumerated. It is the belief
of this governing body that the control of said beach fires is vital
to protecting the health, safety and welfare of the Borough's residents
and visitors by preserving the air quality and the safety of the Borough's
ocean beaches as well as adjoining residential areas.

A. There is hereby established a nonrefundable permit fee of $50 for
a beach fire or beach party or picnic with a beach fire. A $300 deposit
of cash or certified check will be required to be posted with each
permit application. The full amount of the deposit will be retained
by the Borough in the event any of the rules and regulations for the
beach fire are violated. Said permit is to be applied for through
the Borough's Administration Office and shall be issued by the Borough
Administrator, Borough Clerk or designee. Permits shall be granted
to Seaside Park residents or property owners who are 21 years of age
or older and who shall be responsible and must be present during any
party or picnic having a beach fire and requiring a permit.

B. A permit may be withheld or temporarily suspended by the Police Department.
Conditions that warrant said permit withholding or suspension include,
but are not limited to, severe weather conditions, including winds
that could endanger the air quality of adjoining residential areas,
high winds causing difficulty in controlling fire or any other severe
or dangerous weather condition.

There are hereby established rules and regulations for beach
fires as allowed and permitted by this article:
A. One beach fire permit shall be issued per day and shall only be issued
to Seaside Park residents or property owners who are 21 years of age
or older who shall be responsible and must be present during any party
or picnic having a beach fire and requiring a permit.
B. Beach fire permits shall only be issued for designated areas located
upon the ocean beach as determined by the governing body of the Borough
of Seaside Park.
C. Beach fire permits shall only be issued between May 16 and September
15 of each year to be held between the hours of 6:00 p.m. and 11:00
p.m.
D. All beach fires must be contained within the Borough-issued fire
ring at the above-designated location and shall be completely extinguished
by 11:00 p.m.
E. Only unpainted wood shall be burned. No treated lumber, wood with
nails or wood longer than 24 inches shall be burned. No other materials
shall be burned or placed in said fires.
F. The fire must be allowed to burn down to ashes and be extinguished
by water only. (Do not extinguish with sand as it fills the fire ring.)
G. All fire areas must be cleaned up and all unburned materials are
to be removed from the beach and subject to proper disposal other
than Borough-issued garbage cans.
H. It is the responsibility of the group to properly dispose and remove
from the beach any litter, recycling, garbage, trash and/or food at
the conclusion of the beach fire, party or picnic.
I. There shall be no glass bottles or alcoholic beverages allowed upon
the public beaches and at any permitted beach fire, party or picnic.
J. Any destruction of Borough property, i.e., beach fencing, lifeguard
equipment, concession stand, will cause immediate revocation of the
permit and forfeiture of the deposit.
K. The use of generators is prohibited.
L. The amplification of music is prohibited.
M. Attendance at beach fires shall be limited to 75 people.
N. At the conclusion of the beach fire, a police officer will make inspection
of the area to make sure that all conditions of the beach fire permit
have been complied with and issue report to the Borough offices. A
secondary inspection will be made by the Public Works Department who
shall also issue a report to Borough offices.

The Police Department shall enforce this article upon recommendation
of the Public Works Department.
This article shall not apply to Borough-sponsored events which
shall be exempt from the provisions of this article.
Any person who violates any one or more sections of this article shall be subject to the general penalty in Chapter
1, Article
II, General Penalty, of the Borough Code.
