A. No person, firm or corporation, public service, water, light or power
company shall open or excavate in any street, highway or sidewalk
within the limits of the Village of South Floral Park without first
procuring written permission therefor from the Administrator of the
Village to whom there shall be made a formal application. Each application
must be written, signed by the applicant and submitted to the Administrator
and is to contain a general description of the location, together
with the dimension of the excavation; a statement of the purpose of
such excavation and the period of time it is to remain open; and the
applicant is to state therein that he indemnifies the Village from
any and all damages resultant from injury to life, limb or property
caused by such excavation. For each excavation there shall be made
a separate application.

B. Barricades and lights required. All excavations in streets or sidewalks
shall be surrounded by suitable barriers, guards and temporary covers
for the protection of persons using the streets in the daytime and
in addition thereto by lights or flares from twilight continuously
until daylight.

Except where otherwise provided by law or where permits are
granted above at direction of the Village, each application for such
permit shall be accompanied by a fee of $50 for each excavation to
be paid to the Village Administrator.
No person shall be permitted to tunnel under any street in any
manner whatsoever, but shall completely cut through said street from
the surface thereof or shall drive his or its piping in the manner
known in the plumbing trade as "driving."

This article shall apply to any public service corporation operating
in the Village.

Any person committing an offense against any provision of this
article shall, upon conviction thereof, be guilty of a violation pursuant
to the Penal Law of the State of New York, punishable by a fine not
exceeding $250 or by imprisonment for a term not exceeding 15 days,
or by both such fine and imprisonment. The continuation of an offense
against the provisions of this article shall constitute, for each
day the offense is continued, a separate and distinct offense hereunder.
