The user/service charges for water
and/or sewer services shall generate adequate annual revenues to pay
costs of annual operation and maintenance of the water and sewer systems
including replacement and costs associated with debt retirement associated
with financing of the water and sewer system and/or any capital costs
associated with said systems which the City may designate to be paid
by the user/service charge. The water and sewer user/service charge
shall be set by ordinance and together with the systems shall be self-supporting.
The City shall bill customers for any and all miscellaneous charges
set forth by State and Federal law, examples of which may include,
but are not limited to, primacy fees, laboratory testing, etc.

A. For the purpose of repair or replacement
of the privately owned water lines extending from the water main to
a residential dwelling, which are the responsibility of each property
owner, due to failure of the line, the City of O'Fallon is hereby
authorized to impose a fee not to exceed one dollar ($1.00) per month
or twelve dollars ($12.00) annually on residential property for each
water service line providing water service within the City of O'Fallon
to residential property having four (4) or fewer dwelling units for
the purpose of paying for the costs of necessary water service line
repairs or replacements.
B. Any funds collected pursuant to this fee
shall be deposited in a special account to be used solely for the
purpose of paying for all or a portion of the reasonable costs associated
with and necessary to administer and carry out the water service line
repair program.

A. Each customer, user and/or owner of premises
connected to the water system of the City with a meter size of one
(1) inch or less shall pay for water drawn from the water system of
the City according to the readings of the water meters in each particular

All usage fees per one thousand (1,000) gallons over the 1,000-gallon
per-month minimum are for each one thousand (1,000) gallons or portion
thereof. The monthly base rate portion of the bill shall be multiplied
by the number of months included on the bill. Similarly, the monthly
allowance [one thousand (1,000) gallons] included in the monthly base
rate shall be multiplied by the number of months included on the bill.
The charges established herein shall continue in force until different
charges are adopted. The charges established after the last year in
the table will be an annual increase of six percent (6%) over the
previous year and these annual increases shall continue in force until
different rates are adopted. New charges start each year at the beginning
of a full billing cycle on or after January 1 of the year indicated.

C. A charge for water service shall be made
based upon the meter readings and computed at the rates and fees hereinabove
set out. The City, through its properly authorized employees, may
read water meters and/or bill for services monthly, bi-monthly, quarterly
or some other periodic basis, based on the charges set forth above,
and may combine bills for water service with bills for City solid
waste and/or sewer services provided to the same location. If such
unified billing is adopted, the City Administrator shall adopt a policy
to establish the sequence of the services being billed to which partial
payments shall be applied. Failure of the City to submit a service
bill or a delinquent notice shall not excuse the water customer from
their obligation to pay for water service when a bill is submitted.
D. Whenever, for any cause, a water meter
fails to operate, or for some reason a meter cannot be read by the
City, a reasonable estimate shall be made by the City of the amount
of water supplied during such period and the customer/user shall be
liable for payment based on the estimated amount of water.
E. Water meters will be owned and maintained
by the City. Water meters will be kept in proper operating condition
by the City and meter tests will be made in accordance to the testing
methods set forth by the American Water Works Association. Water meters
damaged or destroyed through tampering or abuse will be repaired or
replaced by the City at the customer's expense.
F. Meter tests will be performed as deemed
necessary by the City at no charge to the water user. Water meter
errors which do not exceed two percent (2%) fast or slow shall be
considered as being within the allowable limits of accuracy for billing
purposes. The percentages of error will be considered as that arrived
at by taking the average of the error at full load and that at ten
percent (10%) load, unless a water user's rate of usage is known to
be practically constant in which case the error at such constant use
will be used.
G. Due to supply and capacity limitations
on the City's water and sewer systems for the foreseeable future,
no additional water service connections will be made to premises outside
the City limits of O'Fallon if the property is located in an area
served or to be served by the City of O'Fallon sewer system. Any owner
or property located outside the O'Fallon City limits desiring to connect
to and acquire water from O'Fallon's water system must apply to the
City Council for an extension of service and must demonstrate to the
satisfaction of the City Council in its sole and unlimited legislative
discretion, by deed restriction, contract running with the land, or
other satisfactory means:
1.
That the use, development and any
redevelopment of the property to be served is not, and will not be,
incompatible with the scale and character of the permitted uses for
nearby property within the City;
2.
That the property will not be further
subdivided or converted to any use other than that described in detail
in the application for extension of service without the consent and
agreement of the City Council, which consent shall be vested in the
Council's sole and unlimited legislative discretion;
3.
That the property will not be connected
to the City's sewer system without consent of the City Council in
the Council's sole and unlimited legislative discretion; and
4.
That no additional property other
than the property described in the application for extension of service
will be allowed to connect to any lines extended beyond the City limits
without the consent of the City Council, which discretion shall be
vested in the Council's sole and unlimited legislative discretion.
H. A discount equivalent to fifteen percent
(15%) of the total monthly charges (not including late fees, penalties,
interest, returned check fees, payment cancellation fees, collection
costs, etc.) is available to individual residential customers (but
not multi-unit, institutional, commercial, industrial or other customers)
upon proof that he/she is either over the age of sixty-five (65),
or a veteran of the United States Armed Forces with a service-connected
disability of at least twenty-five percent (25%). Proof of age must
be in the form of a driver's license, State identification card, passport,
or other government-issued ID issued by a government within the United
States. A service disability must be verified by the United States
Department of Veterans Affairs.

I. Customers receiving a bill from the City
for water service shall be given the opportunity to designate a voluntary
contribution of one dollar ($1.00), three dollars ($3.00) or five
dollars ($5.00) that shall become the amount due from the customer
and payable as that customer's bill, and the voluntary contribution
will be donated to a not-for-profit organization designated by the
City. The terms for such contribution shall be set forth in an agreement
executed between the City and the designated not-for-profit organization(s)
and kept on file with the City Clerk. The designated not-for-profit
organization(s) may change without notice to the customer.

B. Customers without O'Fallon approved water
meters shall have the option of installing an approved water meter
at their sole expense or paying a flat rate sewer charge based on
the water/sewer usage of fifteen thousand (15,000) gallons per month
per each commercial, business or residential unit.
C. If a commercial or industrial contributor
has a consumptive use of water, or in some other manner uses water
which is not returned to the wastewater collection system, does not
use metered City water or has a water source in addition to City water,
the user charge for that contributor will be based on a wastewater
meter(s) or separate water meter(s) installed and maintained at the
contributor's expense and in a manner acceptable to the City.
D. Each customer, user and/or owner of premises
connected to the sewer system of the City with a water meter size
of greater than one (1) inch shall pay for sewage treated by the wastewater
system of the City according to the readings of the water meters at
the same usage fees indicated for one (1) inch and smaller meters.
The monthly base rate for properties with water meters greater than

E. All new structures connected to the sewer
system shall have a City approved water meter installed on the incoming
water line.
F. Effective January 1, 2012, the charge for
wholesale sewer service customers located outside of the City of O'Fallon
shall be equal to the usage fee (per 1,000 gallons) paid by customers
within the City of O'Fallon. The City Council may by contract approve
a different charge. For purposes of this Section, a "wholesale sewer
service customer" is one to whom the City provides sanitary sewer
service for resale to the ultimate consumer.
I. Any user which discharges any pollutants
which cause an increase in the cost of managing the effluent or the
sludge from the City's sewer system, or any user which discharges
any substance which singly or by interaction with other substances
causes identifiable increases in the cost of operation, maintenance
or replacement of the sewer system shall pay for such increased costs.
The charge for each such user shall be as determined by the responsible
plant operating personnel and approved by the City Council.
J. Due to the limited treatment capacity of
the sewer plant, no additional sewer service connections will be made
to premises outside the City limits of O'Fallon unless approved through
mutual agreement of the parties involved.
K. A discount equivalent to fifteen percent
(15%) of the total monthly charges (not including late fees, penalties,
interest, returned check fees, payment cancellation fees, collection
costs, etc.) is available to individual residential customers (but
not multi-unit, institutional, commercial, industrial or other customers)

L. All single-family residential properties
having one (1) water meter serving one (1) unit shall, for all billing
purposes within both the water and sewer systems, be considered as
having a one (1) inch water meter regardless of the actual size of
the water meter installed.
M. All residential customers shall be billed
for sewer usage based on their respective average winter water use,
minimum of two (2) months, as determined by water meter reading(s)
gathered between each November 1 and March 31 period. Once this winter
water usage is determined, the sewer charge will remain unchanged
until the next winter water usage is determined. When winter water
usage is not available on the account, the sewer bill will be based
on an average residential use of six thousand two hundred (6,200)
gallons a month until the winter water use data is available.
N. Non-residential customers shall be billed
for sewer service based on actual water or sewage meter readings.
O. All rates and fees contained herein shall
be valid from the date of approval and not expire until a new rate
is established.
P. The City, through its properly authorized

statements for services shall be rendered on a periodic basis, based
on the charges set forth above. The monthly base sewer base rate portion
of the bill shall be multiplied by the number of months included on

gallons] included in the monthly base sewer base rate shall be multiplied
by the number of months included on the bill. The City may combine
bills for sewer service with bills for City solid waste and/or water

Customers who request initiation
or discontinuance of water and/or sewer service for a portion of the
billing period may receive a prorated bill for that portion of the
billing period that service is received.

Any person found to have turned on
or off a water meter, water valve, sewer meter, sewer valve, or fire
hydrant, or otherwise intentionally tampered with same, without authorization
by the City, shall upon conviction be subject to a fine not to exceed
five hundred dollars ($500.00) or imprisonment not to exceed three
(3) months, or both such fine and imprisonment; and such person shall
also be liable for the expense of any necessary repair.

A. Water and/or sewer service shall be deemed to be furnished to both
the occupant and owner of all establishments receiving service, and
the occupant and owner of such establishments shall each be severally
and jointly liable to the City for payments of the charges for the
premises upon which establishments are located. The City may sue the
occupant, the owner, or both, of the establishments receiving water
and/or sewer for which such service has been made available, and receive
any sums due for such services, including penalties and costs incurred
by the City and a reasonable attorneys' fee and the costs of such
suit.
B. The City Administrator, in coordination with the departments of water
and sewer and finance, may adopt administrative procedures to bill,
receive, account for and enforce collection of all charges by any
lawful means, including filing suit, and may fix a reasonable time
when payments shall be due, assess and collect reasonable fees, charges
for late payment, returned checks, rejected payments, and other collection
measures, including interest thereon at the rate allowed by law. Service
may be discontinued for non-payment of any fees or charges and restoration
of service may be withheld until all obligations owed to the City
are satisfied.
C. For delinquent customers who are in arrears for more than three (3)
months receiving sewer service only, the City may notify the water
utility serving the premises for the purpose of disconnecting water
service as provided under State law or of disconnecting the sewer
service connection and closing access to the City sewer system.
D. For delinquent customers who are in arrears for more than three (3)
months receiving sewer service only where water service is provided
by a private well, the City is authorized to excavate and install
a sewer valve on the sewer lateral for the purpose of disconnecting
the customer's sewer line from the City's sewer system. The City shall
send notice to such customers at least thirty (30) days prior to disconnection.
The City shall not be responsible for damages for any failure to remove
wastewater from the customer's premises or for backup of wastewater
into customer's premises or for an interruption of service when discontinuation
of service is required under this Section.
E. All new installations of sewer service lateral where water service
is provided by a private well shall be required to have a sewer valve
installed on the service lateral. This sewer valve shall be installed
at or near the property line or other location approved by the City.
