[R.O. 2009 §16.50.200]
As used in this Declaration of Protective Covenants, the following
words and phrases shall have the meanings indicated:
BOARD
The Board of Trustees of the Sikeston Business, Education
and Technology Park.
COMMON SPACE AND COMMON AREA
Those areas of land shown on any recorded plat or otherwise
designated by recorded document in Scott County, Missouri, comprising
a portion of the Sikeston Business, Education and Technology Park
tract, which are identified on the plat or in the document as "Common
Area of Sikeston Business, Education and Technology Park" or by substantially
equivalent language.
DECLARATION
These protective covenants and all other provisions set forth
in this entire Document, as the same may from time to time be amended,
which relate to all or part of the property in Sikeston Business,
Education and Technology Park.
DESIGN AND DEVELOPMENT STANDARDS
Those standards for site planning, exterior building design, landscaping and site amenities, exterior lighting and exterior signs and monuments as set forth in Article
III of this Declaration.
INTERIOR STREET
A public street located within the Sikeston Business, Education
and Technology Park.
LOT
Any parcel or tract of real property designated as a lot,
parcel or tract on any recorded plat of Sikeston Business, Education
and Technology Park or any additions thereto, with the exception of
the common area and any lot, parcel or tract which is created by a
minor subdivision recorded with the Scott County Recorder of Deeds.
A lot shall not be less than five (5) acres in area.
OWNER
The record owner of a fee or undivided interest in any lot,
parcel or tract of the property and shall not include persons or entities
who hold an interest in any lot, parcel or tract merely as security
for the performance of an obligation. Except as stated otherwise in
this Declaration, the term "owner" shall not include
a lessee or tenant.
PLAT
A recorded plat covering any or all of the property referred
to in this Declaration.
PROPERTY
That real property included within the preliminary plat or
plats and final plat or plats of Sikeston Business, Education and
Technology Park which is described on Exhibit "A" and such real property
as may hereafter be acquired by the City for purposes of expansion
of Sikeston Business, Education and Technology Park.
RULES
Those rules and regulations promulgated by the Board of Trustees
under the authority granted by this Declaration.
VARIANCE
Includes use variances and design and construction variances.
VISIBLE FROM NEIGHBORING PROPERTY
With respect to any given object, that such object is or
would be visible to a person six (6) feet tall, standing on any part
of such neighboring property at an elevation no greater than that
of the base of the object being viewed.
