For the purposes of this Chapter, the following terms, phrases,
words and their derivations shall have the meaning given to them in
this Section. When not inconsistent with the context, words used in
the present tense include the future, words in the plural number include
the singular number and words in the singular number, the plural number.
GARAGE SALE
Includes all general sales, open to the public, conducted
from or on residential premises in any residential zone, as defined
by the zoning ordinance, for the purpose of disposing of personal
property including, but not limited to, all sales entitled; "garage",
"lawn", "yard", attic", "porch", "room", "back yard", "patio", "flea
market" or "rummage" sale. This definition shall not include a situation
where no more than five (5) specific items are held out for sale and
all advertisement of such sale specifically names those items to be
sold; nor does this definition include, nor this Chapter regulate,
individuals or groups of individuals who hold or conduct not more
than six (6) garage sales at any one (1) location in the City during
a calendar year.
GOODS
Includes any goods, wares, merchandise, articles or other
personal property capable of being the object of a sale regulated
hereunder.
PERSON
Any person, firm, partnership, association, corporation,
company or organization of any kind.

It is unlawful for any individual to sell or offer for sale,
under authority granted by this Chapter, property other than personal
property.

It is unlawful for any person to conduct more than six (6) garage
sales at the same location within any calendar year.

Any person proposing to conduct a garage sale must notify the
Department of Public Works office of the place where such sale is
to be conducted, the dates of such sale and the names, addresses and
telephone numbers of the person responsible for conducting such sale.

It is unlawful to conduct a garage sale lasting longer than
three (3) days' duration.

No person shall erect, place, post or mark any sign advertising
a garage sale on any public property, including street signs and posts
and traffic signs and posts or on any public utility posts.

No person shall accept or take in for sale any goods from any
commercial business or enterprise on a consignment basis.

No goods offered for sale at a garage sale shall be displayed
for sale on any public street or right-of-way.
