For the purpose of this Chapter, the following terms and words
are herewith defined as follows:
ALLEY
A public vehicular right-of-way affording only a secondary
means of access to the rear or side of properties otherwise abutting
on a street.
BENCH MARKS
Permanent markers incased in concrete installed at the corners
of all subdivisions. The permanent marker elevation shall be based
on U.S.G.S. elevations.
BLOCK
A property abutting a street between the two (2) nearest
intersections or intercepting streets. A railroad right-of-way of
the boundary line of undivided acreage or a body of water shall be
regarded the same as an intersection for the purpose of defining a
block.
BUILDING LINE
A line on a plat between which line and the street, alley
or lot line no building or structure may be erected.
CITY COMPREHENSIVE PLAN
A plan adopted by the Commission and Council with accompanying
maps, plats, charts and descriptive material for the physical development
and land uses including streets, schools, parks, open space, public
utilities and similar facilities within the corporate limits of Sikeston,
Missouri.
COMMISSION
The City Planning and Zoning Commission of Sikeston, Missouri.
COUNCIL
The City Council of Sikeston, Missouri.
EASEMENT
A specific area of land over which a liberty, privilege or
advantage is granted by the owner to the public, a corporation or
some particular persons or part of the public for specific uses and
purposes and which is designated a "public" or "private" easement
depending on the nature of the user.
IMPROVEMENTS
Paving, grading, storm sewers and appurtenances, sanitary
sewers and appurtenances, water mains and hydrants and any other facilities
deemed necessary by the City Council.
LOT
A parcel of land occupied or intended for occupancy by a
use permitted in the zoning ordinance, including one (1) main building
together with its accessory buildings, the open space and parking
spaces required by the zoning ordinance and having its principal frontage
upon a street or upon an officially approved place.
MAJOR THOROUGHFARE PLAN
A street plan adopted by the Commission and Council with
accompanying maps, plats, charts and descriptive material that indicates
the general location, character and extent of streets for Sikeston,
Missouri.
MONUMENT
Markers such as iron pipes or iron pins a minimum of twenty-four
(24) inches in depth, crosses or arrows on walks, curbs or pavements
that will not be removed or destroyed during the construction of the
necessary improvements; provided however, that exact distance and
course to the crosses and arrows are shown on the subdivision plat.
PLAT
A map or chart of a subdivision of land.
PLAT, FINAL
A map of all or part of a subdivision providing substantial
conformance to the preliminary plat of the subdivision prepared in
conformance with the requirement of this Chapter and suitable for
recording by the County Recorder.
PLAT, PRELIMINARY
A map showing all requisite details of a proposed subdivision
submitted to the Commission and City Council for purposes of preliminary
consideration, prepared in conformance with this Chapter.
PUBLIC RESERVATION
A portion of a subdivision which is set aside for public
use and made available for public use or acquisition.
PUBLIC UTILITY
Any individual, firm, association, syndicate, corporation,
partnership, municipal department, board or commission duly authorized
to furnish and furnishing under governmental regulations to the public:
facilities, products or services, such as gas, steam, electricity,
sewage disposal, communication, telegraph, transportation, water,
etc.
PUBLIC WALKWAY
A right-of-way dedicated for the purpose of a pedestrian
access through residential areas and located so as to connect to two
(2) or more streets or a street and a public land parcel.
SIDEWALK
A pedestrian walkway with a permanent surface.
STREET
A place, avenue, court, drive, lane, combination of road
and utility easement or thoroughfare over which pedestrians, private
or public vehicles may pass inclusive of any parking or walk areas.
A street provides primary means of access to abutting property.
1.
MAJOR: A street of considerable continuity
connecting various sections of the City and designated as a major
street on the major thoroughfare plan for Sikeston, Missouri.
2.
SECONDARY: A through street which collects
traffic from minor streets and connects to major streets and designated
on the major thoroughfare plan for Sikeston, Missouri.
3.
MINOR: A street which is generally located
or used for residential purposes and primarily provides access to
abutting property and designated on the major thoroughfare plan for
Sikeston, Missouri.
4.
MARGINAL ACCESS STREET: A minor street paralleling
and adjacent to a major thoroughfare which provides access to abutting
properties and protection from through traffic and designated on the
major thoroughfare plan for Sikeston, Missouri.
5.
BOULEVARD STREET: A street developed to two
(2) multi-lane, one-way pavements, separated by a median and designated
on the major thoroughfare plan for Sikeston, Missouri.
6.
TURNAROUND: A short boulevard street permanently
terminated by a vehicular turnaround and designated on the major thoroughfare
plan for Sikeston, Missouri.
7.
CUL-DE-SAC STREET: A minor street of short
length having one (1) end open to traffic and being permanently terminated
at the other end by a vehicular turnaround and designated on the major
thoroughfare plan for Sikeston, Missouri.
8.
LOOP STREET: A minor street of short length
with two (2) openings to traffic beginning from the same street and
projecting parallel to each other and connecting at their termination
by a loop and designated on the major thoroughfare plan for Sikeston,
Missouri.
SUBDIVIDER
A person, firm or corporation undertaking the subdivision
or resubdivision of a tract or parcel of land for the purpose of laying
out a platted addition or subdivision of land.
SUBDIVISION
1.
The division of any parcel of land shown as a unit or as contiguous
units on the deed records of the Recorder of Scott County, Missouri,
and New Madrid County, Missouri, on the next day preceding the effective
date of the initial Sikeston subdivision regulations ordinance into
two (2) or more parcels, sites or lots, any one (1) of which is less
than five (5) acres for the purpose, whether immediate or future,
of transfer of ownership; providing however, that the division or
partition of land into parcels of more than five (5) acres not involving
any new streets or adjoining lot owners, where such sale or exchange
does not create additional building sites, shall be exempted; or
2.
The improvement of one (1) or more parcels of land for residential,
commercial or industrial structures or groups of structures involving
the division or allocation of land for the opening, widening or extension
of any street or streets except private streets serving industrial
structures; the division or allocation of land as open spaces for
common use by owners, occupants or lease holders or as easements for
the extension and maintenance of public sewer, stormwater drainage
or other public facilities.
3.
Multiple-family residential developments, mobile home parks and planned shopping centers, involving either public or private streets and accessways, shall be considered subdivisions pursuant to Subsection
(2) of this definition and plats therefor shall be required.
VARIANCE
A modification of the strict terms of the relevant regulations
where such modification will not be contrary to the public interest
and where owing to conditions peculiar to the property and not the
result of the action of the applicant, a literal enforcement of the
regulations would result in unnecessary and undo hardship.
VICINITY MAP
A drawing located on the plat which sets forth by dimensions
or other means the relationship of the proposed subdivision or use
to other nearby developments, landmarks, community facilities, watershed
and services within or adjacent to the City in order to better locate
and orient the area in question.
ZONING OFFICER
The public official designated by the City Manager as being
responsible for the processing of zoning applications as well as subdivision
plats. The Zoning Officer shall be responsible for the administration
of the zoning and subdivision regulation ordinances.
