This Chapter shall apply to the installation and use of television
dish-type satellite antennas.

A. Any and
all dish-type satellite antennas shall be located in the rear yard,
and in the case of a corner lot, the antenna cannot be located closer
to the side street than the main building (home) is permitted to be
located.
B. Any and
all parts of the dish-type structure shall be located a minimum of
ten (10) feet from any rear or side property line.
C. No dish-type
antennas shall be located on the roof of a residential building.
D. The dish-type
antenna, from its base to the top of the antenna shall not exceed
twenty (20) feet in height.
E. All dish-type
antennas shall be adequately anchored to the ground so as not to constitute
a safety hazard in winds of one hundred (100) miles per hour velocity.
F. The installation
of the dish-type antenna shall be in accordance with the applicable
Electrical Code and Building Code as adopted by the City of Northwoods,
and all associated wiring shall be placed underground.
G. A building
permit is required before any dish-type antenna shall be installed.
Precise drawings shall be submitted to the City of Northwoods along
with the permit application before any application will be considered.
H. Only
one (1) dish-type antenna shall be permitted to each homesite lot.
I. No person
shall permit another person to connect any wires or attachments so
that more than one (1) home will be served by any one (1) antenna.
J. Subsections
(A) through
(I), inclusive, of this Section shall apply to residential lots, and not to any lots that are zoned commercial, unless the following Sections of this Chapter specifically require application of Subsections
(A) through
(I) to commercial lots.

Should any owner or lessee desire to locate a dish-type satellite
antenna on or about said commercial premises, said request shall be
made in writing, and presented to the Planning and Zoning Commission
of the City of Northwoods. Said request shall be in detail, stating
the proposed location of said antenna, and the height and diameter
of said antenna.

Upon receipt of said request for antenna for commercial purposes,
the Planning and Zoning Commission shall hold at least one (1) public
hearing wherein the person requesting such antenna shall be present
to explain his/her request.

After the public hearing outlined in Section
555.040, the Planning and Zoning Commission shall meet and consider the request, and in accordance with their duties, determine if the request is in the best interests of the citizens of the City of Northwoods.

Any commercial dish-type satellite antenna submitted for approval
must be accompanied by the normal fee charged for building permits.

Any person violating any of the provisions of this Chapter shall
be subject to a fine of not more than one thousand dollars ($1,000.00),
or three (3) months in Jail, or any combination of both said fine
or Jail time. Each day a violation continues shall be considered a
separate violation.

If any Section or provision of this Chapter shall be in conflict
with any regulation of the Federal Communications Commission concerning
the usage or restriction of dish-type satellite antennas, then said
Section or provision of this Chapter shall not be controlling.
