As used in this Title, the following term shall have the prescribed
meaning:
UTILITIES
The providing of water, sewage, electricity, gas, or any
other services provided by the City whether owned and operated by
the City or purchased by the City for resale.

There shall be established hereunder a Public Works and Natural
Gas Committee composed of one (1) Alderman from each ward, appointed
by the Mayor and approved by the Board of Aldermen. Members will be
appointed annually at the first (1st) meeting of the Board of Aldermen
in May. A Committee member may only be removed for cause, by the Mayor
and with consent of two-thirds (2/3) of the full Board of Aldermen.
At the first (1st) meeting after appointments have been made, a Chairman
will be elected. All members will retain their right to vote on any
issue before the Public Works and Natural Gas Committee and all decisions
shall be made by a majority vote of the members appointed to the Committee.
Meetings of the Public Works and Natural Gas Committee shall be called
by the Chairman of the Committee in accordance with the rules of this
Chapter.

The Public Works and Natural Gas Committee shall have jurisdiction
to hear any matters concerning utilities as provided by the City including,
but not limited to, complaints concerning billings, payments, service
and discontinuance of service. The City Administrator shall have authority
under this Chapter to established procedures, policies and specifications
for any extension of utility services beyond the date provided for
discontinuance.

A. Customers
who wish to have the Public Works and Natural Gas Committee to hear
any complaint concerning billings, payments, service and discontinuance
of service shall make such request in writing. Upon such request,
the Chairman of the Public Works and Natural Gas Committee shall call
a meeting and notify all parties involved as to the date, place and
time of the meeting. Such appeal shall not preclude the timely payment
of any utility related bill or bills, but should a decision be rendered
in behalf of a customer, a credit to the account of the customer shall
be made as directed by the Public Works and Natural Gas Committee.
The Public Works and Natural Gas Committee shall notify the customer
requesting the review of its decision as soon as possible.
B. Any customer
who wishes to have the decision of the Public Works and Natural Gas
Committee reviewed by the Board of Aldermen may do so by making such
request in writing within ten (10) days after the decision of the
Public Works and Natural Gas Committee. The Board of Aldermen shall
review the decision of the Public Works and Natural Gas Committee
at the next regularly scheduled meeting following the request for
review.

Nothing herein shall restrict the authority of the Board of
Aldermen of St. Robert to take any action or make any decision that
it deems necessary.

The City Administrator, or the Public Works and Natural Gas
Committee acting when the position of City Administrator is vacant,
shall not review any bill which has not been presented within ninety
(90) days of the billing date.

When the position of City Administrator is vacant, or when the
Public Works and Natural Gas Committee is reviewing a decision of
the City Administrator, a complete list of customers who are currently
in arrears on their utility bills shall be furnished to the Public
Works and Natural Gas Committee prior to its meetings by the appropriate
clerk.
