No person shall carry on any occupation, trade or business within the City of Albany, Missouri, as hereafter in this Chapter enumerated or defined in subsequent Sections herein without first procuring therefor a license so to do from the City of Albany, Missouri.

Where any person engages in more than one (1) form of occupation, trade or business, as provided in the "Schedule of Licenses" set out in Article II of this Chapter, at a single location, under the same ownership, same management, same building and roof, for which a license is required, such person shall pay for a license only for the occupation, trade or business requiring the highest tax.

The various occupations, trades, or businesses listed in Article II, "Schedule of Licenses", of this Chapter, shall be construed in their broadest sense; in all cases of doubt such occupation, trade or business listed in Article II shall be presumed to be applicable to the prospective licenses.

A license shall be required before any person may engage in any of the occupations, trades or businesses as may be required by this Chapter, and when such license has been established on an annual or yearly basis, it shall be effective and in force from January first (1st) until the last day of December, next following; provided however, that when any license is issued under the provisions of this Chapter after the first (1st) day of July of any year, the license tax levied thereon shall be one-half (½) of the annual rate and shall expire on the last day of December. Licenses provided for in this Chapter on a daily or weekly basis shall state the time, and dates for which the license is issued.

A. 
All applicants for a license under the provisions of this Chapter shall apply in person or by agent at the office of the City Collector in the City of Albany, Missouri, and shall pay to such Collector the amount of license tax levied on such trade, business or occupation as herein provided for and required. If upon examination the Collector determines that all of the provisions and requirements of this Chapter have been complied with and that the applicant is entitled to a license, such Collector shall issue a license to such person which license shall also be signed by the Mayor and/or City Clerk of Albany, Missouri, with the Seal of the City thereto affixed.
B. 
No occupational license shall be issued to any applicant until all personal property taxes, real estate taxes, licenses, taxes, fees and any other special charges and assessments due the City from the applicant have been paid in full. In the event any applicant is a corporation, limited liability company, limited liability partnership or other entity authorized and existing under the laws of the State of Missouri, then no occupational license shall be granted to the applicant until any person owning at least a ten percent (10%) interest in the entity to be licensed shall have paid all such taxes and assessments in full.

No license shall be issued upon any game, mechanical machine or mechanical device which involves any chance or risk or gamble.

Every person licensed in any occupation, trade or business under the provisions of this Chapter shall post in a conspicuous place in his place of business, the license herein provided, where such person occupies a place of business. In the event the licensee does not occupy a permanent place of business, such person shall carry such license on his person at all times when engaged in the occupation, trade or business for which the license was issued, and every licensee shall exhibit said license so issued on demand by any Officer of the City of Albany, Missouri, or by any prospective customer.

The City Collector shall keep a book in which he shall register all licenses granted, showing the date, commencement and termination of each license, to whom granted, for what trade, business or occupation, the location thereof, and the amount of the license tax paid.

Any license issued under the provisions of this Chapter may be revoked, for cause, at the discretion of the Board of Aldermen. In the event any license is revoked as herein provided, the City shall refund to the licensee the amount of such license tax so paid.

Any person who shall engage or participate in doing any business in the City of Albany, Missouri, for which a license is required by this Chapter, nor shall any person assist, directly or indirectly, in doing such business or any part of the same, in the manner, either as owner or proprietor, or as any officer of any corporation, or as manager, superintendent, agent, servant or employee, unless a license for carrying on or exercising such business shall have been duly issued and shall be in force as in this Chapter shall be deemed guilty of a misdemeanor.

Any person before engaging in any of the following occupations, trades or businesses within the City of Albany, Missouri, shall first procure from said City a license authorizing such person to carry on such occupation, trade or business. Such license fee or tax shall be paid to the City Collector of the City of Albany, Missouri, and the charge therefor for the various occupations, trades or businesses shall be the amount as set opposite the occupation, trade or business as follows:
AUCTION STORES
Every person, firm, company or corporation who shall within the City of Albany, Missouri, sell or offer to sell within the City of Albany, Missouri, goods, wares, and merchandise at auction, except as hereinafter provided, or conduct what is commonly known as an auction store upon any street, avenue, alley or within any building, tent, or other place within the City where goods are sold at auction to the highest bidder, whether auctioned by the owner or by some other person for him or them, shall pay to the City of Albany, Missouri, a license fee therefor in the sum of twenty dollars ($20.00) per day for each and every day said auction is held or the sum of four hundred dollars ($400.00) for a yearly license.
Said license fee herein provided shall not apply to second-hand goods (except those that are brought in from other towns for the mere purpose of selling), which are sold upon the street corner or at the residence, or at some point in the City of Albany for the mere purpose of disposing of the second-hand goods, neither shall this apply to a closing out sale at auction of any stock of goods, wares or merchandise, when the stock so being sold is a part of a regular store that has been conducted as such within the City of Albany for a period of one (1) year or more prior to such sale, and when said sale is conducted by the owner of said stock who was the owner of it during the period of one (1) year prior to said sale as above set forth, when said sale is a bona fide closing out sale of the stock of goods, wares or merchandise.

HAWKER OR HUCKSTER
Any person selling, attempting to sell or expose for sale, on the streets of Albany, Missouri, either from a vehicle, pack or by any other means, any goods, wares and merchandise of any kind, including but not confined to produce, fish, meats, fruits, berries, melons, eggs, butter and other agricultural produce shall pay to the City Collector of Albany, Missouri, a fee of twenty dollars ($20.00) per day for each and every day such applicant shall sell, or attempt to sell or expose for sale any of the goods, wares and merchandise herein described. No person described in this paragraph shall sell or offer to sell or hawk or peddle any article or thing on any street comprising the square of the City of Albany, Missouri, or within one (1) block from said square, either in the City Parking Lot or at such other places as may, from time to time, be set aside by the Board of Aldermen.
