This Chapter shall be known and may be cited as "The Aerial
Agricultural Spraying Code."

A. Any
owner, operator or pilot utilizing the facilities of the Albany Municipal
Airport for aerial agricultural spraying operations (hereinafter referred
to as "spraying"), whether commercial or private, must register with
the City of Albany, Missouri, prior to utilizing the airport facilities,
on forms approved by City. Said registration will provide the following
information:
1. Name, address and telephone number of owner of aircraft.
2. Name, address and telephone number of operator and pilot, if different
than owner.
3. Aircraft type and identification number for each aircraft.
4. Type of agricultural chemicals to be sprayed.
5. Certificate of insurance showing liability insurance coverage in
the amount of not less than one million dollars ($1,000,000.00) per
occurrence.
6. One hundred dollars ($100.00) cash bond in the favor of the City
of Albany, Missouri, to be refunded at the conclusion of spraying
operations and after inspection as described in Section 255.050 below.

Aircraft engaging in spraying operations may not be operated
on or in any way utilize the facilities of Albany Municipal Airport
traffic unless the aircraft has on board radio equipment capable of
making contact with Albany Municipal Airport traffic at frequencies
122.8 and 122.9. The pilot of any such aircraft shall make a radio
announcement of intent to land as required in the Airman's Information
Manual at least one (1) mile from Albany Municipal Airport and also
prior to leaving the apron when taking off.

Bulk storage of aircraft fuel other than that stored by the
City of Albany for resale is prohibited.

The cash bond required with application will be refunded, after
inspection by a duly authorized representative of the City, if the
operation site designated for the aircraft used in spraying is free
of evidence of any spills of chemicals, fuels, lubricants, chemical
containers or debris of any kind.

Loading of agricultural chemicals onto an aircraft used in spraying
shall be permitted only at the location designated by the City. No
vehicular traffic shall be permitted to and from any other point except
the designated loading site. No vehicles transporting agricultural
chemicals are to be located on premises for more than eight (8) consecutive
hours. Parking will be in designated areas only.

The site used for loading agricultural chemicals onto the aircraft
must be bermed with pigs, absorbent socks, dikes or some other suitable
absorbent material that is EPA approved. All spills will be promptly
reported, properly contained according to EPA regulations and promptly
dealt with at registrant's expense.

Aircraft operators engaged in spraying agricultural chemicals
will not overfly populated areas of the City and will follow all standard
air traffic control procedures in approaching, landing and takeoffs.

Violation of this Chapter is hereby declared to be a misdemeanor
and upon conviction thereof, the violator shall be punished by a fine
not to exceed five hundred dollars ($500.00) or by imprisonment in
the City Jail for a term not to exceed ninety (90) days, or by both
such fine and imprisonment.

Permission to utilize the airport facility is a revocable license,
which may be revoked at any time with or without cause by the City.
