An owner and the occupant of property commit a summary offense
if any weeds on the property are allowed to grow to a height of nine
inches or more.
At least seven days prior to prosecuting a violation of this
chapter, notice of the proposed prosecution will be mailed to the
owner and occupant of the premises by first-class mail. Only one notice
is required to be mailed to the owner and occupant of the premises
each calendar year. If a notice is mailed for a violation in March
and there is a second violation in September, the Borough is not required
to send a new notice to either the owner or occupant before pursuing
remedies under this chapter.
After the seven-day period specified under §
171-2, the Borough may enter upon the property and have the weeds cut at the property owner's and/or occupant's expense, which cost shall be recoverable as a cost of prosecution.
This chapter shall not apply to fields and pastures containing
one acre or more in area being used for agricultural purposes and
to woodlands and wetlands containing one acre or more in area except
that any area abutting a street or sidewalk must comply with this
chapter for a five-foot buffer strip along such street or sidewalk.
For the purposes of this chapter, the following terms shall
have the meanings indicated:
WEEDS
Any grass, weed or herbaceous vegetation whatsoever, including
any plants designated as noxious weeds, but excluding edible plants
and/or useful or ornamental plants that have been planted, cultivated,
and maintained in an orderly manner. From time to time by resolution,
the Borough Council may categorize specific plants as noxious weeds
under this chapter.
A person convicted of violating this chapter commits a summary offense and shall be punishable as set forth in Chapter
1, Article
I, General Penalty, §
1-1 of this Code.
