It shall be unlawful for anyone to participate in a parade or procession of any kind unless a permit has been issued for the parade or procession.
A. 
General rule. An application for a permit shall be submitted to the Borough Secretary, and shall contain the following information:
(1) 
The name and address of the sponsor of the parade or procession, the names and addresses of at least two of the principal officers of the sponsoring organization, and the name and address of the person designated by the sponsor to be in charge of the parade.
(2) 
The purpose of the parade or procession.
(3) 
The proposed date and time of the parade or procession. The date shall be at least 60 days subsequent to the date of application for the permit.
(4) 
The proposed route of the parade or procession.
(5) 
The anticipated number of participants in the parade or procession.
B. 
Fee. A fee of $25 shall accompany the permit application. Borough Council reserves the right to waive the fee.[1]

The date, time and route of the parade or procession shall be determined by the Council and set forth in the permit.
The sponsor shall be responsible for all costs associated with the parade or procession, including, but not limited to, police and fire protection, damage to persons and property, and cleanup.
As a condition of issuing the permit, the Borough Council may require the sponsor to obtain liability insurance and/or post a surety company bond to cover the costs of police and fire protection, personal injury to participants, spectators and bystanders, damage to property, including Borough property, and cleanup. The bond and/or liability insurance shall be in such amount as the Council reasonably believes to be necessary to cover the anticipated costs enumerated above.
A. 
Weapons. No firearm or other weapon may be carried by participants in a parade or procession, unless specifically authorized in the permit.
B. 
Animals. Any animals in a parade or procession must be followed by a cleanup squad, which shall immediately clean up any droppings.
C. 
Flags; banners; signs. The permit may restrict the size and manner of construction of flags, banners, signs and similar devices.
D. 
Parades and processions having as their sole purpose the advertisement or promotion of a product or service are prohibited.
A. 
Denial. The Council may deny issuance of a permit applied for under this chapter:
(1) 
If any required information is not provided in the permit application or is determined to be untrue; or
(2) 
If it determines that the size or nature of the parade will disrupt to an unreasonable extent the movement of traffic or the public peace, or will require a greater number of police officers than are available to the Borough.
B. 
Cancellation. The Council, Mayor or Chief of Police may cancel a permit issued under this chapter:
(1) 
If any condition or term of the permit or provision of this or any other applicable ordinance is not complied with; or
(2) 
By reason of disaster, public calamity, riot or other emergency.
Violation of any provision of this chapter shall constitute a civil offense punishable as set forth in Chapter 1, Article I, General Penalty, § 1-2 of this Code.
