This chapter shall be known as the Mount Wolf Borough "Yard/Garage Sale Ordinance."
It shall be unlawful for any person, firm or corporation to conduct any sale of personal property on any public or private property within the Borough of Mount Wolf, York County, Pennsylvania, without first registering for such sale with the Borough of Mount Wolf. Said sales requiring such registration shall be sales commonly known as "yard sales," "garage sales," "porch sales," "patio sales" or "basement sales."

Every person, firm or corporation desiring to engage in or conduct a sale requiring registration as set forth in § 232-2 above shall first notify the Mayor of the person's name, address and telephone number and the location of sale, date of sale, hours of sale and such other information as is deemed appropriate from time to time by the Borough Council of Mount Wolf Borough.
A. 
No person, firm or corporation shall conduct more than two sales requiring registration as set forth in § 232-2 above during any calendar year.
B. 
Nonprofit organizations may not conduct more than three sales requiring registration under § 232-2 above during any calendar year.
C. 
No sale requiring registration under § 232-2 above shall be conducted for more than three days on any one registration.
D. 
No sale requiring registration as set forth in § 232-2 above shall be conducted between the hours of 9:00 p.m. and 6:00 a.m.
Violation of any of the provisions of this chapter by any person, firm or corporation shall constitute a civil offense and shall be punishable, in addition to having any registration revoked, without refund, as set forth in Chapter 1, Article I, General Penalty, § 1-2 of this Code.
