[HISTORY: Adopted by the Borough Council of the Borough of Mount Wolf 4-14-2009 by Ord. No. 2009-01. Amendments noted where applicable.]
As used in this chapter, the following terms shall have the meanings indicated:
ROLLER BLADES
Roller skates or in-line skates.
SKATEBOARD
A device propelled by human power and gravity consisting of material or portion material formed into a thin firm sheet with wheels attached to the underside. This definition includes such devices that may include steering devices or handlebars which extend upward from the sheet. Devices covered may commonly be known as a "scooters," "skateboard," or "street luge."
SKATEBOARDING
This is the act of propelling, riding, performing stunts or tricks, or otherwise using a device defined herein as a "skateboard" or "roller blades."
A. 
It shall be unlawful for any person to engage in skateboarding or to ride upon, or propel any skateboard upon any of the public roads or sidewalks in the Borough in any manner that is in conflict with the provisions of this chapter.
B. 
It is unlawful to engage in skateboarding or to ride upon, or propel any skateboard or roller blades upon, parking lots and parks owned or operated by the Borough or its authorities.
C. 
It shall be unlawful for any person to engage in skateboarding upon the personal property or the real property of the Borough of Mount Wolf or its authorities in a manner inconsistent with the customary and ordinary use of that property. Skateboarding is therefore prohibited on places such as playground equipment, picnic tables, grandstands, seating areas, etc., except any area where the Borough, by resolution, provides otherwise.
D. 
It shall be unlawful for any person to engage in skateboarding upon the following roads in the Borough of Mount Wolf: North and South Main Street, Maple Street from Main Street to the Borough line, and Center Street.
It shall be unlawful for any person to engage in skateboarding or ride upon, or propel any skateboard upon any public thoroughfare, public sidewalk, public park, public right-of-way, or public street during the following times:
A. 
From dusk until dawn on any day; and
B. 
At any other time when there is insufficient light or when the atmospheric conditions/weather are unfavorable, such as during any precipitation, or when there are measurable accumulations of moisture, ice or snow on the surface used for skateboarding.
A. 
A person engaging in skateboarding or the use of a skateboard shall obey all traffic and pedestrian control signals as provided under the Pennsylvania Motor Vehicle Code.
B. 
A person engaging in skateboarding or the use of a skateboard shall obey the instructions of a police officer or other person authorized to direct, control or regulate traffic.
The person engaging in skateboarding shall yield the right-of-way to any pedestrian and may not overtake or pass a pedestrian while riding on or propelling the skateboard. The operator of such skateboard shall dismount from the skateboard and shall pass or overtake a pedestrian on foot, or wait until the pedestrian passes, prior to remounting the skateboard.
No person engaged in skateboarding shall suddenly leave a curb, berm or street or any other place of safety and ride upon or propel any skateboard into or toward the path of a vehicle which is so close as to constitute a hazard. Persons engaged in skateboarding upon a roadway shall ride as near to the right of the roadway as practical, exercising due care when passing a standing vehicle.
No person shall place a ramp, half-pipe or other structure used for skateboarding in or on a public thoroughfare, public right-of-way, public street or public sidewalk within the Borough.
No person under the age of 16 shall engage in skateboarding in any public place without wearing a helmet and footwear with secure attachments to both the top of the foot and to the heel.
Any person who shall violate any of the provisions of this chapter shall be subject to one or more of the following penalties:
A. 
The skateboard of any person violating the provisions of this chapter or the skateboard being used in violating the provisions or this chapter shall be impounded by the Northeastern Regional Police Department for a period not exceeding 30 days.[1]

B. 
If the violation of this chapter is related to the use of a ramp, half-pipe or other structure employed for skateboarding [collectively "skating structure(s)"], the skating structure(s) shall be impounded by the Northeastern Regional Police Department for a period of time not to exceed 30 days.[2]

C. 
Sentenced to pay a fine of up to $100 plus any costs due for each violation under the chapter. For example, should a person be skateboarding on a Borough sidewalk and using a skating structure, the person would be subject to two fines and costs associated with same.
A. 
Any person who has his/her skateboard and/or skating structure impounded for violating this chapter shall be responsible for picking up same after the period of time for impounding has expired. Any items impounded under this chapter will only be released to the owner, or in the case of a minor, to his/her parents, guardian or person having legal custody. Any item impounded shall be picked up at the Northeastern Regional Police Department unless otherwise directed by the Northeastern Regional Police Department.
B. 
Any skateboard or skating structure impounded under this chapter that has gone unclaimed for a period of 120 days from the date of impounding may, at the Northeastern Regional Police Department's discretion, be discarded, destroyed, forfeited and/or the like. The Northeastern Regional Police Department shall provide reasonable notice of 20 days to the owner/user of a skateboard and/or skating structure before destroying and/or discarding same as set forth herein.
