This chapter shall be known and may be cited as the "Certificate of Occupancy Ordinance."
From and after the passage of this chapter, a certificate of occupancy shall be required prior to the occupancy, change in occupancy, change in ownership, use or change in use of land and/or prior to the occupancy, change in occupancy, use or change in use of any building or portion thereof presently erected or which may hereafter be erected or structurally altered. The certificate of occupancy shall indicate that such building or land has been inspected by the Code Enforcement Officer, the date of said inspection, that the proposed use is in conformity with the provisions of Chapter 395, Zoning, and/or that the building and any additional alternation thereof complies with the Tinicum Township Building Code[1] and all other Township ordinances. This chapter shall not apply to a change in occupancy of rooms in hotels and motels used for occupancy by guests.

The owner or agent of an owner of real property must obtain all appropriate permits, complete any required work and obtain a final inspection approval prior to the issuance of a certificate of occupancy.
The Code Enforcement Officer shall grant or refuse to issue a certificate of occupancy within 10 working days after receipt of a written application therefor filed by the owner or agent for the owner.
The Code Enforcement Officer shall, within five days after issuance of the certificate of occupancy, furnish a copy thereof to the Township Treasurer.

The owner or agent for the owner shall pay to the Township of Tinicum, with the application for a certificate of occupancy, the fees as hereinafter provided:

All inspections requiring in excess of 1 hour to complete shall incur additional fees at the rate of $100 per additional hour.
Property owners or agents of property owners requiring reinspections shall pay as additional fees 1/2 of the initial inspection fees provided hereinabove for each reinspection.

Any person, firm or corporation violating any of the provisions of this chapter shall, upon summary conviction, be liable to pay a fine of not less than $10 or more than $600 and costs of prosecution and in default of the payment of said fine and cost, shall be incarcerated for a term not exceeding 30 days.
