A. 
The Borough of Vandergrift (hereinafter called the "Borough") has heretofore approved and will enter into financing arrangements with the Pennsylvania Infrastructure Investment Authority ("Pennvest") concerning the construction of a certain necessary extension to the Borough's sewer system in the Lower West Vandergrift Area of the Borough (the "1995 Lower West Vandergrift Area Expansion Project"); and
B. 
Under the terms of said financing arrangements, the Borough is required to properly maintain its sewer system; and
C. 
Bove Engineering Company of Greensburg, Pennsylvania, the consulting engineers for the Borough, have recommended a schedule of sewer service rates and a special connection fee which will meet the conditions of the Borough's requirements under the aforesaid financing arrangements, although it is recognized that this schedule, and the basis thereof, may have to be altered to comply with changing conditions in the future.
The schedule of sewer service rates and special connection fee for the 1995 Lower West Vandergrift Area Expansion Project as recommended by the Borough's Consulting Engineers be, and it hereby is, adopted by Vandergrift Borough. A copy of said schedule of sewer service rates and special connection fee for the 1995 Lower West Vandergrift Area Expansion Project is attached hereto and made a part hereof and marked "Schedule A."

The sewer service rates to be charged for service furnished by Vandergrift Borough's Sewer System shall be as follows:
A.
Residential:
For each equivalent domestic unit (EDU) - $15 per month.
An equivalent domestic unit (EDU) with regard to residential customers shall be defined as any room, group of rooms or enclosure, occupied or intended for occupancy as separate living quarters for a family or other group of persons living together or by persons living alone.
B.
Commercial:
For each equivalent domestic unit (EDU) - $15 per month.
An equivalent domestic unit (EDU) with regard to commercial customers shall be defined as any office, store, shop, motel, hotel, restaurant, club, tavern, barber or beauty shop, service station, funeral home, or other similar commercial establishment selling a product or rendering a service, or any religious, fraternal or governmental establishment. Each commercial EDU in a building or complex of buildings shall be considered to be a separate EDU even though it may be located in the same building with a domestic unit or units or other commercial units.
C.
Industrial:
The Borough will treat industrial customers as if they were commercial customers for the present but reserves the right to establish rates for industrial customers at other than the charge for commercial customers as set forth above.
D.
Rate revisions:
The Borough specifically reserves the right to alter in the future this schedule and the flat-rate (EDU) basis upon which it is predicated and to adopt a water-usage-basis schedule calculated to return approximately the same revenues as anticipated in the above schedule.
The connection fee to be charged to each property in Vandergrift Borough connecting new sewer service to the Vandergrift Sewer System shall be $4,840.
Bills for said sewer service shall be rendered in the manner and in the form to be prescribed by the Borough. All bills for sewer service shall be rendered to the owner or, after proper arrangements, to the tenant of the premises to which the sewer service is furnished; nevertheless, the owner of the premises shall in all cases be liable for the payment of such bills.
The Borough Council shall have ultimate responsibility for management of the sewer system, and it shall continue to issue such rules and regulations governing the use, operation and maintenance of said sewer system as from time to time shall be deemed necessary.
The sewer service rates and special connection fee imposed hereunder shall be due and payable immediately upon receipt of the bill by the owner and shall be paid not later than the due date appearing on the bill. Said charges shall be subject to a five-percent penalty if not paid within 20 days from their due date. If not paid within 60 days after said due date, the charge plus the penalty shall bear interest at the rate of 1/2% per month or any fraction thereof until paid.
The Borough shall collect and receive all sewer service rates and special connection fees prescribed under this article.
The sewer service rates imposed by this article shall become effective on and after January 1, 1995, and the special connection fee for the 1995 Lower West Vandergrift Area Expansion Project shall become effective upon substantial completion of the construction of the proposed 1995 Lower West Vandergrift Area Expansion Project.
