No person, firm or corporation shall cut into, tunnel under,
or in any manner disturb the surface of any street, alley or sidewalk
in the City without first applying for and obtaining from the Recorder/Treasurer
a written permit to do so, which shall be dated, and shall give the
name and address of the person to whom the permit is granted, and
the location of the place where the street, alley or sidewalk is to
be cut into, tunneled under, and the purpose for which said permit
is granted.

Any person, firm or corporation applying for said permit shall
estimate in writing the number of square feet to be cut or tunneled.
Before such permit is granted, the applicant shall deposit with the
City a road-cut permit fee in the sum of $10 pre square foot for asphalt
or concrete streets, public driveways or parking lot repairs; or $5
per square foot for gravel street, public driveways or alleyway repairs;
or $7 per square foot for concrete sidewalk repairs.

All excavations made are to be restored to their original condition
to the satisfaction of the Mayor or his/her appointee. All persons
who shall cause a paved, City maintained street to be cut for whatever
purpose, shall repair said road cut utilizing, at a minimum, the standards
shown on the attached schematic drawing. The surface course shall
be of reinforced concrete. Upon the completion of the repair, the
person supervising the repair shall provide to the City Street Superintendent
a written and dated statement, signed by the supervisor, that the
repair was made in compliance with the standards.

A. Title.
This ordinance shall be known as an "Ordinance Codifying a Fee for
Street Cuts, and for Other Purposes."
B. Findings.
The City Council finds that the City of Lincoln has long charged a
fee for street cuts, but that the fees have never been established
by ordinance. For clarity, consistency in fees and the need to account
for the presence of funds in City accounts during audits, the City
Council further finds it necessary to codify and establish a set fee
for street cuts.
C. Fee established.
From and after the effective date of this ordinance, the City shall
charge the following fees for street cuts:
(1) For
gravel street cuts: $25 per square foot.
(2) For
paved street cuts: $35 per square foot.
