A. 
The Zoning Officer shall receive all applications for grading permits and shall collect the application fees. The Zoning Officer shall transmit a copy of the application to the Borough Engineer or Consulting Engineer, as the case may be.
B. 
The Borough Engineer or Consulting Engineer shall review the application and recommend approval or disapproval by the Zoning Officer. In the event disapproval is recommended, the Borough Engineer or Consulting Engineer, as the case may be, shall note the reasons therefor and a copy of the recommendation shall be sent to the applicant.
C. 
If revisions are requested by the Borough, the applicant shall resubmit three copies of any revised grading plans to the Borough for review.
D. 
The Zoning Officer shall issue a grading permit upon the recommended approval from the Borough Engineer or Consulting Engineer.
A. 
Where the Zoning Officer finds that an application for a grading permit remains incomplete after due notice to the applicant or that the proposed work is not in conformance with this chapter or other Borough ordinances, the grading permit shall be denied.
B. 
Where, in the opinion of the Borough Engineer or Consulting Engineer, the work as proposed by the applicant is likely to endanger any person, property or road or create a hazardous condition, the grading permit shall be denied. In determining whether the proposed work is likely to endanger any person, property or road or create a hazard, the Borough Engineer or Consulting Engineer shall give due consideration to erosion, possible saturation by rains, earth movements, runoff surface waters and subsurface conditions such as the stratification and faulting of rock aquifers, springs and the nature and type of the soil or rock.
C. 
Any applicant or permit holder shall have the right to appeal within 15 days from the date of the denial of the grading permit or other adverse determination by the Zoning Officer under Article VII hereof, by a written appeal therefrom to Borough Council. Borough Council shall grant a hearing upon such an appeal within 30 days after the receipt of the written appeal. Borough Council shall consider appeals from the decision of the Zoning Officer and shall make determinations of alternate methods, standards or materials when in its opinion strict compliance with the provisions of this chapter is unnecessary.

Every grading permit shall expire and become null and void if the work authorized by such permit has not been commenced within three months or is not completed within one year from the date of issue, provided that Borough Council, acting upon the recommendation of the Borough Engineer or Consulting Engineer, may, if the permit holder presents satisfactory evidence that unusual difficulties have prevented work being started or completed within the specified time limits, grant a reasonable extension of time, and provided further that the application for the extension of time is made before the date of expiration of the grading permit.
B. 
Any physical changes uncovered in the development site during construction such as surface water drainage, soil and bedrock dislocations, alteration of groundwater discharge or any other natural or man-made modification which were not addressed in the permit application or the approved grading plan, must be immediately reported to the Zoning Officer by the permit holder. If the circumstances dictate or if a hazard exists, the Zoning Officer shall revoke the grading permit or otherwise modify the conditions upon which the permit was initially issued.
The applicant shall be responsible for all costs incurred by the Borough, or its professionals, agents, consultants and the like, in connection with the approval and construction of a development site as follows:
A. 
Such costs incurred shall include, but not be limited to, inspection, review, completion, maintenance, engineering, legal, remedial, and administrative;
B. 
In the sole discretion and judgment of Borough Council, review, inspection and other fees and costs of the Borough and the Borough's professionals, agents, consultants and the like, as well as costs of construction, completion, repair and maintenance, may be secured by one or more escrow accounts on such terms and in such amounts acceptable to the Borough, or by bonds in such amounts and issued by bonding companies acceptable to the Borough, or by such other financial security acceptable to the Borough;
C. 
In the case of any escrow account, interest earned on amounts held therein, if any, shall be credited to such escrow account;
D. 
Replenishment of such escrow accounts or renewal of such bonds or other financial security may be required by the Borough from time to time in such amounts as shall be determined by the Borough; and
E. 
Failure to establish, maintain and replenish such escrow accounts, or failure to procure, maintain and renew such bonds or other financial security, shall be cause for all processing of an applicant's grading permit hereunder, or construction pursuant thereto, to cease; provided, however, that if such construction is completed at the time of such failure, such failure shall be grounds for an action by the Borough against the property owners.
