The purpose of this article is to protect the Township of Stowe and the residents who live within from any and all financial responsibility which could possibly arise from a spill or leak of any chemical, material or substance as set forth within this article, whether it be in use, storage or transit.
This article shall apply to anyone who uses, stores, or transports any chemical, material, or substance (as set forth within this article) within any area of the Township of Stowe, regardless of whether that area is federally owned, state-owned, municipally owned, publicly owned, or privately owned.
A. 
Any and all costs associated with a spill or leak of any chemical, material, or substance as set forth within this article, whether it be in use, storage, or transit, shall be borne by the owner, lessee, or whomever was responsible for the chemical, material, or substance being used, stored, or transported within the Township of Stowe.
B. 
Such costs shall include, but are not limited to, cleanup, police action, fire department action, any emergency action taken by the Township, and any reasonable and necessary expense incurred by the Township as a result of the spill or leak.

The chemicals, materials and substances subject to this article shall include, but not be limited to:

Acetone.
B. 
Ammonia.
C. 
Benzene.
D. 
Calcium carbide.
E. 
Carbon disulfide.
F. 
Celluloid.
G. 
Chlorine.
H. 
Hydrochloric acid.
I. 
Hydrocyanic acid.
J. 
Magnesium.
K. 
Nitric acid and oxides of nitrogen.
L. 
Petroleum products (gasoline, fuel oil, etc.).
M. 
Phosphorus.
N. 
Potassium.
O. 
Sodium.
P. 
Sulfur and sulfur products.
Q. 
Pesticides (including insecticides, fungicides and rodenticides).
R. 
Radioactive substances.
S. 
Hazardous materials and hazardous wastes as defined by the United States Department of Transportation, Federal Highway Administration in 49 CFR Part 172 and the United States Environmental Protection Agency in 40 CFR 261.11.
