A. Whenever the Mayor or City Administrator
declares a festival occurring in or around any City park, property
or facility for the purpose of a festival or event open to the public,
the entire area of land will reside within the corporate City limits
of O'Fallon, including residences, businesses and commercial establishments,
streets, parks, common ground and all other areas encompassed by the
boundaries declared as the Festival District.
B. The special restrictions, limitations and
conditions described in this Article will be in effect during the
dates and times specified by the Mayor or City Administrator in the
festival declaration.

Whenever a festival district is declared,
notification shall be, but not be limited to, public announcements
on the O'Fallon cable public access channel and publication in one
(1) Recreation Department brochure delivered to substantially all
residences within the Festival District and the majority of other
City residents. This notification shall be made at least fifteen (15)
days before the first day of the festival event. The City may utilize
other means of notification as it may deem appropriate from time to
time.

The O'Fallon Police Department is
hereby authorized to tow and impound any vehicle(s) parked in violation
of any restrictions established pursuant to this Article. It will
be the responsibility of the owner of any towed or impounded vehicle
to pay for any tow or impoundment charges or fees.

Whenever a festival is declared,
parking restrictions on streets and thoroughfares within the Festival
District will be in effect during the dates and times of the festival
as deemed appropriate by the City of O'Fallon Parks and Recreation
Departments and Police Department and shown on signage posted at reasonable
intervals and locations in the Festival District area. The City will
endeavor to list festival restrictions from time to time on the website
located at www.ofallon.mo.us.

The City of O'Fallon is authorized
to change traffic flow patterns, establish one-way streets, add, delete
or alter any traffic control device(s), restrict parking, control
ingress and egress from all public streets, public or private parking
lots or private roadways, or establish any other traffic control measures
deemed necessary to assist in the traffic flow and to ensure emergency
vehicle access in association with a declared festival, subject to
approval by the City Traffic Engineer and the Chief of Police. However,
the Chief of Police or his/her designee may implement or utilize any
reasonable traffic control measures without the approval of the Traffic
Engineer in an emergency situation.

A. When the Mayor or City Administrator declares
a festival and the Festival District is established, the following
restrictions shall be in place:
1.
No weapon, knife, firearm, projectile weapon, blackjack or other weapon capable of lethal use may be carried or displayed in a Festival District in violation of restrictions of Sections
215.250 and
215.280 of the Code of Ordinances.
2.
Temporary shelters such as tents,
large umbrellas, gazebos, dining canopies, etc., will not be allowed
during the festival times.
3.
It is unlawful for any person(s)
to bring glass containers into the areas specified in this Section,
above, during the festival times. Non-motorized "coolers," defined
as any device used to keep beverages, foods or ice cool, may be brought
into the above indicated areas but are subject to search by law enforcement
or park personnel at any time.
4.
All persons are hereby prohibited
from bringing animals of any type, with the exception of service animals
or Police canine or horses, into any area specified in this Section,
above, during a festival as declared by the Mayor or City Administrator.
This includes pets on leashes or other restraints.
5.
It is unlawful for any person(s)
to ride skateboards, roller blades, in-line skates, bicycles, motorized
coolers or any unauthorized motorized vehicle, in the areas specified
as the festival district declared, during any festivals.
6.
Soliciting or distribution of handbills
is not allowed unless you are an authorized vendor or sponsored with
a permit to do so.
7.
Fireworks, other than the City-sponsored
display, are not allowed in the festival district.
8.
Any other restrictions deemed necessary
by the City Administration, Police Chief or Director of Parks and
Recreation will be posted at the entry to the festival and on the
website www.ofallon.mo.us.

Conviction of a violation of any provision of this Article is punishable by a fine as set out in Section
100.010 of this Code.
