The following words, when used in this article, shall have the meanings ascribed to them in this section, except in those instances where the context clearly indicates otherwise.
BULK WASTE
Large items of solid waste, including but not limited to appliances, furniture, rugs, carpets, mattresses, box springs, mirrors, glass-top tables, bathroom fixtures, white goods (dishwashers, ranges, stoves, refrigerators), tires, building and construction materials or any other items requiring special handling due to size, shape or weight.
DWELLING
Any building or structure, which is wholly or partly used; or intended to be used; or available for use; or available to be used for living or sleeping of one or more persons.
DWELLING UNIT
A single unit providing complete independent living facilities for one or more persons functioning as a family, including permanent provisions for living, sleeping, eating, cooking and sanitation. A single-family dwelling and a condominium unit shall be considered a dwelling unit.
OPERATOR
Any person, corporation, partnership or similar entity which has charge, care or control of property or any part thereof, in which dwelling units are rented, leased or let out within the Township of Tinicum.
OWNER
Any person, corporation, partnership or similar entity which alone, or jointly or severally with others, shall have legal title to any dwelling or dwelling unit with or without accompanying actual possession thereof, or shall have charge, care or control of any dwelling or dwelling unit as an owner or agent of the owner, or as executor, administrator, trustee or guardian of the estate of the owner.
PROPERTY
Shall consist of land, buildings, structures and other improvements for the use of operating a dwelling or rental unit.
RENTAL UNIT
A rental unit is any dwelling, dwelling unit, structure, building, ground or portion thereof that is occupied or used pursuant to a rental agreement with a tenant or occupant.
A. 
The Board of Commissioners of the Township of Tinicum shall regulate the collection of all bulk waste within the Township and make regulations concerning the day of collection, the type and the location of pickup and such other matters pertaining to the collection and disposal.
B. 
All bulk waste accumulated within the Township of Tinicum shall be collected, disposed of and restricted by the Township of Tinicum in accordance with this article.
C. 
The Board of Commissioners of the Township of Tinicum may add, modify or change the bulk waste policy from time to time as it may deem appropriate.
A. 
The Township of Tinicum shall no longer provide for curbside collection of bulk waste for operators of and non-owner-occupied dwelling unit(s) or rental unit(s) subject to or operating under a duly issued Township of Tinicum rental dwelling license.
B. 
Every owner or operator of a dwelling or rental unit(s) subject to or operating under a duly issued Township of Tinicum rental dwelling permit shall be required to arrange and contract for the private collection and disposal of all bulk waste with a hauler or collector licensed for the collection, transport and disposal of bulk items.
C. 
Nothing contained in this article shall affect the curbside collection of garbage, rubbish, recycling waste or bulk waste of any resident, tenant or occupant of a dwelling unit(s) or rental unit(s) within the Township of Tinicum.
Any person, firm or corporation which violates or neglects to comply with any provision of this article, or any regulation promulgated pursuant thereto, shall, upon conviction thereof, be punishable by a fine of not more than $1,000 plus cost of prosecution, and, in default of payment of such fine and costs, to imprisonment in the county jail for a period not exceeding 30 days.
If any sentence, clause, section, or part of this article is for any reason found to be unconstitutional, illegal, or invalid such unconstitutionality, illegality or invalidity shall not affect or impair any of the remaining provisions, sentences, clauses, sections or parts of this article. It is hereby declared as the intent of the Board of Commissioners that this article would have been adopted had the unconstitutional, illegal or invalid sentence, clause, section, or part thereof, not been included therein.
All ordinances or parts of ordinances which are inconsistent herewith are hereby repealed and/or replaced.
This article shall become effective upon adoption.
