The efficient and sanitary collection of solid waste is an integral
part of preserving the environmental and aesthetic quality of our
Township. This chapter will ensure the safe and efficient pickup and
disposal of solid waste throughout the Township of Plumsted.
As used in this chapter, the following terms shall have the
meanings indicated.
BRUSH
Shall mean products resulting from the pruning of trees,
shrubs, bushes or vines, but excluding grass clippings, flowers or
weeds. "Brush" shall not mean the product of tree removal or pruning
by professional tree removers, trimmers or landscapers nor shall it
mean tree trunks, stumps or fire wood.
BULK TRASH
Shall mean items in excess of the automated container capacity
excluding building materials and car parts. "Bulk Trash" shall not
mean items collected or generated by commercial establishments or
commercial or professional, movers, haulers, builders or cleaners.
COMMERCIAL
Shall mean any business establishment operating within the
Township of Plumsted.
COMMERCIAL TRASH
Shall mean all garbage and rubbish accumulated by any business
operating within the Township, limited to the capacity of the ninety
(90) or three hundred (300) gallon container.
GRASS CLIPPINGS
Shall mean products resulting from the trimming of lawn grass,
flowers and weeds. "Grass Clippings" shall not mean the products of
trimming lawn grass, flowers and weeds by professional cutters or
landscapers.
INDUSTRIAL ESTABLISHMENT
Shall mean those businesses which include manufacturing,
industrial, research and development entities.
INSTITUTIONAL ESTABLISHMENTS
Shall mean those facilities that house or serve groups of
people, including but not limited to, hospitals, schools, nursing
homes, libraries and governmental offices.
LEAVES
Shall mean the vegetative product of tree branches that annually
drop from the branches.
MULTI-FAMILY UNITS
Shall mean any building or structure under a single roof,
with or without fire wall partitions designed for occupancy by three
(3) or more households living as families. This definition shall also
include apartments, townhouses, condominiums and retirement communities.
"Condominium" as used herein shall include the form of ownership of
real properties under a master deed providing for ownership by one
(1) or more owners of units of improvement together with an undivided
interest in common elements appurtenant to each such unit.
PROOF OF COLLECTION SERVICE
Shall mean a written record, log, bill or document evidencing
receipt of service for the collection of solid waste for the preceding
month from a person lawfully engaging in private solid waste collection
services within a municipality.
REGULAR SOLID WASTE COLLECTION SERVICE
Shall mean the scheduled pick-up and removal of solid waste
from residential, commercial or institutional premises located within
the boundaries of any municipality at least once a week.
RESIDENT
Shall mean any person residing within the Township of Plumsted
on a temporary or permanent basis.
RESIDENT GENERATED BUILDING MATERIAL
Shall mean any refuse generated from the homeowner, and not
a private contractor, in the maintenance and remodeling of the homeowner's
primary residence.
RESPONSIBLE SOLID WASTE GENERATOR
Shall mean any property owner, tenant or occupant of any
single-family residential dwelling or multiple dwelling, or the owner
of any commercial or institutional building or structure located within
the boundaries of any municipality, who generates solid waste at those
premises.
SOLID WASTE
Shall mean garbage, refuse, trash and other discarded materials
resulting from industrial, commercial and agricultural operations
and from domestic and community activities, and shall include all
other waste materials, including liquids except for solid animal and
vegetable wastes collected by swine producers licensed by the State
Department of Agriculture to collect, prepare and feed such wastes
to swine on their own farms.
SOLID WASTE COLLECTION
Shall mean the activity related to pick-up and transportation
of solid waste from its source or location to a solid waste facility
or other destination.
SOLID WASTE CONTAINER
Shall mean a receptacle, container or bag suitable for the
depositing of solid waste.
SOLID WASTE DISPOSAL
Shall mean the storage, treatment, utilization, processing,
or final disposal of solid waste.
SOLID WASTE FACILITIES
Shall mean and include the plants, structures and other real
and personal property acquired, constructed or operated or to be acquired,
constructed or operated by any person pursuant to the provisions of
this or any other act, including transfer stations, incinerators,
resource recovery facilities, sanitary landfill facilities or other
plants for the disposal of solid waste, and all vehicles, equipment
and other real and personal property and rights therein and appurtenances
necessary or useful and convenient for the collection or disposal
of solid waste in a sanitary manner.
TOWNSHIP
Is the Township of Plumsted, County of Ocean, State of New
Jersey.
The Plumsted Township Municipal Utilities Authority is hereby
authorized and directed to establish and promulgate reasonable regulations
detailing the manner, days and times for the collection of solid waste
as designated in this chapter and such other matters as are required
to implement this chapter. The Plumsted Township Municipal Utilities
Authority is hereby authorized and directed to enforce the provisions
of this chapter and any implementing regulations adopted hereunder.
Every responsible solid waste generator whose solid waste is
not picked up by the municipal solid waste collection service in this
Township, shall enter into a contract for regular solid waste collection
service with any person lawfully providing private solid waste collection
services within the Township. The responsible solid waste generator
shall file a notice with the Township Clerk setting forth the name
and address of the solid waste collection service with whom the responsible
solid waste generator has entered into a contract for the collection
of solid waste together with the duration of that contract.
It shall be the responsibility of the owner of a multiple dwelling
or commercial establishment to provide a sufficient number of solid
waste containers for the deposit of non-recyclable waste material
to be disposed of as solid waste.
Prior to the issuance of any building permits, a notice must
be posted on vacant land to clearly inform the public of the penalties
for illegal dumping pursuant to Title 13 of the New Jersey Statutes.
The developer must post a minimum of one (1) notice per each five
hundred (500) linear feet of road frontage.
