A code establishing sterilization, sanitation, and safety standards for persons engaged in the business of tattooing, permanent cosmetics, and ear and body piercing in order to protect the public health is hereby established, pursuant to N.J.S.A. 26:1A-7. A copy of the code is annexed hereto and made a part of this Chapter without the inclusion of the text herein.

The code established and adopted by this Chapter is described and commonly known as the "Body Art Procedures" and N.J.A.C. 8:27.

Three copies of Body Art Procedures have been placed on file in the office of the Secretary of the Oakland Board of Health upon introduction of this Chapter and will remain on file for the use and examination of the public.

a. 
No establishment in the business of tattooing or piercing shall open for business until such times as the Board of Health shall approve same and issue a license to operate.
b. 
No license shall be issued until the establishment has been satisfactorily inspected by the Health Authority.
c. 
The license and inspection shall be renewed annually and is not transferable.
d. 
A fee of $500 shall be paid for the annual license which shall expire on December 31st, annually.
e. 
Violations of the terms of this code shall, upon conviction, be subject to a fine of $500 for the first offense, $1,000 for the second offense, and $1,500 for the third offense, cumulatively.

All future amendments to the code, once promulgated in accordance with the regulations of the New Jersey Administrative Register, shall become a part of this Chapter without further introduction and passage by the Board of Health of the Borough of Oakland.
