No public or quasi-public recreational bathing facility shall
be operated within the Town of Secaucus unless it is in compliance
with Chapter IX of the New Jersey State Sanitary Code (Recreational
Bathing).
It shall be unlawful for any person, partnership, corporation
or other individual to operate a public recreational bathing facility,
as defined and governed in Chapter IX of the State Sanitary Code,
without first having obtained a license from the local Board of Health
or to operate a public recreational bathing facility without complying
with any and all of the provisions contained in this chapter and said
code.

Every applicant for a license pursuant to this chapter shall
make application on forms to be furnished by the Board of Health.
Every license so issued by the Board shall be from January 1 of the
year of issue to December 31 of the same year. Application for the
renewal thereof shall be before January 31 of the year of issue.

The current annual license fee shall be kept on file in the
Town Clerk's Office. The fee is nonrefundable.

Failure to comply with this chapter may result in suspension
or revocation of the license and/or the issuance of a summons in accordance
with this chapter. Any person violating or failing to comply with
any of the provisions of this chapter shall, upon conviction thereof,
be punishable by a fine as follows:
First offense: $300.
Second offense: $600.
Third and subsequent offense: $1,000 (said offense requires
a review meeting with the Board of Health).
The continuation of such violation for each successive day shall
constitute a separate offense, and the person or persons allowing
or permitting the continuance of the violation may be punished as
provided above for each separate offense.
This fine shall in no way limit the licensee's culpability for
compliance with the other provisions of the licensing ordinance.
This chapter shall take effect upon final adoption and publication
as required by law.
