There shall be the following departments under the direct administrative control of the Manager:
a. 
Office of the Manager;
b. 
Department of Finance;

Appointment. Pursuant to N.J.S.A. 40A:9-140.10, the Municipal Council shall appoint a Chief Financial Officer.

Term of Office. The term of office of the Chief Financial Officer shall be four years, which shall run from January 1 in the year in which the Chief Financial Officer is appointed.
c. 
Qualifications. Pursuant to N.J.S.A. 40A:9-140.13 no person shall be appointed or reappointed as a Chief Financial Officer unless such person holds a Municipal Finance Officer Certificate issued pursuant to the provisions of N.J.S.A. 40A:9-140.1 et seq.
d. 
Compensation. The compensation for the Chief Financial Officer shall be set forth in the municipal salary ordinance.

The position of Assistant Treasurer is hereby established.
b. 
The Assistant Treasurer shall be appointed by the Municipal Manager.
c. 
The Assistant Treasurer shall perform the duties of the Municipal Treasurer and such other duties as directed by the Treasurer or Municipal Manager.
d. 
In furtherance of his/her duties, the Assistant Treasurer, where authorized by the Treasurer, is authorized to sign and countersign all checks and warrants and other documents to the same extent as that authority is conferred on the Municipal Treasurer.
e. 
The compensation of the Assistant Treasurer shall be fixed by ordinance of the Borough Council.

Appointment. Pursuant to N.J.S.A. 40A:9-146 et seq., the Municipal Council shall appoint a Municipal Tax Assessor.
b. 
Compensation. The Council shall determine the amount of compensation of the Tax Assessor by ordinance.
c. 
Term of Office; Vacancies.
1. 
The Tax Assessor shall hold office for a term of four years from the first day of July next following his appointment.
2. 
Vacancies other than due to expiration of term shall be filled by appointment for the unexpired term.
d. 
Qualifications; Duties. Pursuant to N.J.S.A. 40A:9-148.1, the Tax Assessor shall hold a Tax Assessor Certificate provided for in N.J.S.A. 54:1-35.25 et seq. and shall have the duty of assessing property for the purpose of general taxation.

Appointment. Pursuant to N.J.S.A. 40A:9-141 et seq., the Municipal Council shall appoint the Municipal Tax Collector.
b. 
Term of Office; Vacancy.

Vacancies other than due to expiration of term shall be filled by appointment for the unexpired term.
c.

The Department shall be headed by a Director who shall be qualified by education and experience and who holds a Public Works Manager Certificate pursuant to N.J.S.A. 40A:9-154.6g.

A person holding office as Director of the Department of Public Works continuously for five or more years shall continue to hold the office during good behavior and efficiency and shall not be removed therefrom for political or other reasons, except for good cause, upon written charges filed with the Municipal Clerk and after a public, fair and impartial hearing.

Snow and ice control;

Recycling trash and refuse collection and disposal;
f. 
Maintenance and repair of public facilities; and

Leaf removal.

The administration of the Police Department shall be under the direction of the Borough Manager, and the Police Chief shall report directly to the Borough Manager. The Borough Manager is hereby designated the Appropriate Authority pursuant to N.J.S.A. 40A:14-118 and may exercise all powers conferred by that designation, including the promulgation of rules and regulations for the Police Department. The Borough Manager shall report all new rules and regulations to the Borough Council.

Before entering upon the duties of their office, members of the Police Department shall make and subscribe to such oath as shall be required by law.

a. 
Classes Enumerated. Before any person shall be appointed as a member of the Police Department, the Municipal Manager shall classify all the duly qualified applicants for the position or positions to be filled in the following classes:
1. 
Class I: Residents of the Borough;
2. 
Class II: Residents of the County of Passaic;
3. 
Class III: Other residents of the State of New Jersey; or
4. 
Class IV: All other qualified applicants.
b. 
Veteran Preference. Within each such classification, duly qualified applicants who are veterans shall be accorded all such veterans preferences as are provided by law. Persons discharged from the service within six months prior to making application to the Department who fulfill the requirements of N.J.S.A. 40A:14-10.1 and who thereby are entitled to appointment notwithstanding their failure to meet the New Jersey residency requirement at the time of their initial application, shall be placed in Class III.
c. 
Order of Appointments. In making such appointments, the Municipal Manager shall first appoint all those in Class I and then those in each succeeding class in the order above listed and shall appoint a person(s) in any such class only to a vacancy remaining after all qualified applicants in the preceding class have been appointed or have declined an offer of appointment.
d. 
Certification of Eligibles for Positions. The classes of qualified applicants defined in paragraph a above shall be considered as separate and successive lists of eligibles, and the Department of Personnel shall, when requested to certify eligibles for positions specified in this section, make such certifications from said classes separately and successively, and shall certify no person from any such class until all persons in the preceding class or classes have been appointed or have declined offers of appointment.
e. 
Applicability. This subsection shall apply only to initial appointments and not promotional appointments of persons already members of the Police Department.
f. 
Temporary Appointments. In making temporary appointments, the Municipal Manager shall utilize the classifications set forth in paragraph a and shall classify all duly qualified applicants for the position to be temporarily filled.

The officers and members of the regular police force shall severally hold their respective employment as such municipal officers and employees during good behavior and efficiency and residence in the State. No such person shall be removed from office or employment in the Police Department, or from the regular police force of the Borough, nor shall any such member of the regular police force be demoted in rank, fined, or be otherwise penalized for political reasons, or for any cause other than incapacity, misconduct, nonresidence or disobedience of established rules and regulations which may be established for the police force or Police Department of the Borough; provided, that any member of the regular police force of the Borough who shall be absent from duty without just cause for the time of five days, shall, at the expiration of five days, cease to be a member of the police force of the Borough.

a. 
The commanding officer of the Police Department shall be the Chief of Police who shall be appointed by the Appropriate Authority. The Chief of Police shall be subject to the rules and regulations established by the Appropriate Authority. The Chief of Police shall cause members of the Department under his/her command to obey the rules and regulations established by the Appropriate Authority. The Chief shall be held responsible for the efficiency, conduct, appearance and good order of the Department and shall promptly report to the Appropriate Authority each and every case dereliction of duty, and all complaints made against members of the Department.
b. 
The Chief of Police shall be in charge of discipline of the force and its officers and personnel. The Chief shall discipline members of the Department by forwarding a charge with a recommended penalty to the Appropriate Authority (in addition to compliance with all other applicable law regarding such a charge). The Appropriate Authority shall either decide the charge himself or designate a hearing officer whose recommended decision shall be subject to affirmation, modification, or reversal by the Appropriate Authority. This procedure does not supersede any collectively negotiated agreement, but merely requires that, after any steps required by such an agreement, the Appropriate Authority render the final decision on discipline (subject to any arbitration provision in a collectively negotiated agreement).
c. 
The Chief of Police shall keep in his office a book or other record in which shall be entered the names and residences of each member of the Department and he shall therein certify the hours of active duty of the several members and note the absentees and those present each day.
d. 
The Chief of Police shall also, with the assistance of such officers as may be detailed for that purpose, keep in the office of the Police Department a "Police Blotter" in which shall be entered the name in full, with the alias of each person arrested or detained by him, or against whom criminal complaint shall be made, and the time of arrest, the nature of the complaint and what disposition was made of the accused; also the name of the person who made the arrest, the names and residences of the witnesses, together with all the circumstances of interest in such case.
e. 
The Chief of Police shall designate the day and night tours of duty and the Police Officer shall patrol the same; arrange and determine special details; and provide for traffic regulation subject to the approval of the Borough Manager.

Appointment. There may be at least one Captain who shall be appointed by the Municipal Manager.
b. 
Duties. The Captain shall perform such duties as may be prescribed by the Chief, and the rules and regulations of the Police Department.

Appointment. There may be one or more Lieutenants who shall be appointed by the Municipal Manager.
b. 
Duties. The Lieutenant shall perform such duties as may be prescribed by the Chief, and the rules and regulations of the Police Department.

Appointment. There may be one or more Sergeants who shall be appointed by the Municipal Manager.

Duties. The Sergeant shall perform such duties as may be prescribed by the Chief, and the rules and regulations of the Police Department.

a. 
The regular members of the uniformed force employed by the Borough shall be known as "Patrol Officers," and shall be subject to all laws of the State of New Jersey regarding the conduct, benefit and protection of police officers or employees of Police Departments in the State of New Jersey. They shall subscribe to, and abide by, the rules and regulations provided in this section and the rules and regulations established by the Borough Manager for the operation and control of the Police Department.
b. 
It shall be the duty of all Patrol Officers, at all times of day or night, to be within their tours of duty. They are empowered to preserve the peace; prevent crime; detect and arrest offenders; suppress riots; protect the rights of persons and property; guard the public health; preserve order at elections; remove nuisances existing in public streets, highways and places; repress and restrain disorderly houses; provide proper Police control at every fire in order that the property exposed may be protected; and enforce every law and ordinance relating to the suppression or punishment of crime. The Patrol Officers shall perform such other duties as may be enjoined upon them by law or ordinance, the Chief of Police, or by the rules and regulations prescribed by the Mayor and Council as herein provided.
c. 
It shall be the duty of all Patrol Officers to enforce the laws of the State of New Jersey and all Borough ordinances; to make complaints in the Municipal Court of every person charged to be guilty of any criminal offense, or of any violation of the ordinances of the Borough to arrest in any criminal cases without a warrant, in case he shall be a witness to the commission of the offense, and in all cases in which a crime or misdemeanor is about to be committed; to arrest all prostitutes and all persons disturbing religious meetings; to stop and examine all persons carrying or in any way conveying goods under circumstances which may indicate that they have been stolen, and when circumstances require, they shall arrest the person or persons, and take possession of the goods.

[1985 Code § 6-3.6]
It shall be the duty of every regular member of the Police Department to acquaint himself at all times with the laws of the State of New Jersey, the ordinances of the Borough, and the rules and regulations of the Department; to examine all cases where he has reason to believe or suspect that the laws or ordinances are being violated, and to report same to the Chief of Police, whose duty it shall be immediately to cause to be investigated such violation and to report such violations and the result of the investigations to the Borough Manager. Failure on the part of any member of the Department or of the Chief of Police to comply with the requirements of this section shall be sufficient grounds for the suspension or dismissal of such officer from service. It shall be the duty of each member of the Department to keep record of all occurrences of an unusual nature that may come under observation while on or off duty, and to enter same in his own handwriting upon the record book in the custody of the Chief. Such entry shall be made daily in ink, and signed by the officer.

a. 
Police Station. The Police station is hereby established in the Borough Hall and shall be in the charge of the Chief of Police.
b. 
Hours of Duty. For the purpose of this section, eight continuous hours of actual duty in each 24 hours shall be deemed a day's service, and five days service (40 hours) shall constitute a week's service; provided, however, that any member of the Police Department may be directed to do police duty in excess of such eight hours per day or 40 hours per week when his services are deemed necessary by the Chief of Police.
c. 
Salaries. The Chief of Police, Captain, Lieutenants, Sergeants, Patrol Officers, Special Law Enforcement Officers, Special Marshals, School Traffic Guards, and Temporary Patrol Officers shall receive such salaries as may be provided by ordinance.
d. 
Vacations. The Chief of Police, subject to the approval of the Borough Manager, shall have the power to apportion and designate to each regular member of the police force the period of each member's vacation; provided that said power is exercised in conformity with such rules and regulations as may be enacted by the Civil Service Commission and adopted by the Borough.
e. 
Uniforms and Equipment. Uniforms and equipment of the regular members of the Police Department shall be furnished in accordance with the rules and regulations of the Department.

In addition to any punishment to which he may be subjected by law, any member of the regular police force may be removed from office by the Borough Manager for the following offenses: intoxication while on duty; willful disobedience of orders; disrespect of a superior; neglect in paying his just debts for rents or necessities of life contracted while on the force; immorality, indecency or lewdness; incompetency, lack of energy and incapacity, mentally or physically; violation of any criminal law or penal ordinance; for making known any proposed movement of the force; for violating rules governing the Municipal Court; or for refusing to do duty of any kind whenever required on patrol or elsewhere, whether in uniform or not.

The Appropriate Authority (Borough Manager) may promulgate rules and regulations for the proper and efficient conduct of the Police Department and the discipline of its members.
[1985 Code § 6-6.1]
a. 
Term. Special Law Enforcement Officers shall be appointed for a term not to exceed one year, and the appointment may be revoked for cause after adequate hearing. Nothing herein shall be construed to require reappointment upon the expiration of the term. Special Law Enforcement Officers so appointed shall not be members of the police force of the Borough.
b. 
Qualifications. No person shall be appointed as a Special Law Enforcement Officer unless such person meets the qualification requirements of N.J.S.A. 40A:14-146.10. The Chief of Police shall submit candidates for appointment to the Municipal Council. The eligibility and qualifications of such persons shall be reported to the Municipal Council by the Chief of Police in accordance with N.J.S.A. 40A:14-146.10e.
c. 
Appointment. Appointment as a Special Law Enforcement Officer shall be made by the Borough Manager.
d. 
Certification Required. No person shall commence serving as a Special Law Enforcement Officer unless he has been certified by the Police Training Commission as provided by N.J.S.A. 40A:14-146.11.
e. 
Classification of Officers. Persons appointed as Special Law Enforcement Officers shall, upon appointment, be designated as either a Class One or Class Two Special Law Enforcement Officer. The classifications shall be based upon the following standards:
1. 
Class One. Officers of this class shall be authorized to perform routine traffic detail, spectator control and similar duties and shall have the power to issue summonses for disorderly persons and petty disorderly persons offenses, violations of Municipal ordinances and violations of Title 39 of the New Jersey Statutes. The use of a firearm by an officer of this class shall be strictly prohibited, and no Class One Officer shall be assigned any duties which may require carrying or use of a firearm.
2. 
Class Two. Officers of this class shall be authorized to exercise full powers and duties similar to those of a permanent, regularly appointed full-time Police Officer. The use of a firearm by an officer of this class may be authorized only after the Officer has been fully certified as successfully completing training as prescribed by the Police Training Commission.
f. 
Firearms. No Special Law Enforcement Officer may be issued a firearm unless he has successfully completed the basic firearms course approved by the Commission for permanent, regularly appointed Police Officers and has successfully completed annual requalification examinations as required for permanent, regularly appointed Police Officers. No Special Law Enforcement Officer may carry a firearm except while engaged in the actual performance of the Officer's official duties and when specifically authorized by the Chief of Police, or, in the absence of the Chief, a Chief Law Enforcement Officer of the Borough and provided that the Officer has satisfactorily completed the basic firearms course and requalification examinations mentioned above. The carrying of firearms by Special Law Enforcement Officers shall be in accordance with N.J.S.A. 40A:14-146.11.
g. 
Hours of Employment. No Special Law Enforcement Officer may be employed more than 20 hours per week except as follows:
1. 
Without limitation as to hours during periods of emergency.
2. 
In such other cases or circumstances as provided by N.J.S.A. 48:14-146.8 et seq.
h. 
Prohibited Employment. No Special Law Enforcement Officer may be employed to replace or substitute for full-time regular Police Officers or to diminish the number of full-time Officers.
i. 
Maximum Number of Officers. The number of Special Law Enforcement Officers employed by the Borough shall not exceed the following:
1. 
Class One Officers: Five.
2. 
Class Two Officers: Five.

The Municipal Manager may appoint as School Traffic Guards, such persons as he shall deem to be qualified for such position. The powers and duties of School Traffic Guards shall be limited to the protection of children while on public thoroughfares in the Borough in connection with their attendance at the several schools in the Borough, and to the direction and regulation of pedestrian and vehicular traffic at the various street intersections and crossings where they may be stationed.
While on active duty, School Traffic Guards shall be under the jurisdiction of, and subject to the orders of, the Chief of Police.

The Municipal Manager may appoint as Special Marshals such persons as he shall deem to be qualified for such position. Special Marshals shall be subject to call for the purpose of performing general police duty in time of emergency or upon any occasion when their services are required for the protection of persons and property in the Borough.
While on active duty, Special Marshals shall be under the jurisdiction of, and subject to, the orders of the Chief of Police, and shall have police powers, including the power of arrest.
No such Special Marshal shall carry a revolver when on active duty.

The Municipal Manager may appoint as Temporary Police Officers such persons as he shall deem to be qualified for such positions.
Temporary Police Officers shall perform general police duties on an hourly, daily, or other basis, while regular members of the police force are on vacation, or are absent from duty by reason of illness or some other cause, or whenever, in the judgment of the governing body, the services of such persons shall be required.
While performing police duties, Temporary Police Officers shall be subject to all departmental regulations, and be under the jurisdiction of and subject to the orders of the Chief of Police, and their services may be terminated at the expiration of the need for such temporary employment.

No person who shall serve as Special Law Enforcement Officer, School Traffic Guard, Special Marshal or Temporary Police Officer, or who shall perform any duties of a police nature prior to appointment as a regular member of the Police Department shall be entitled to credit for any such periods of duty, or services rendered, either with or without pay, on account of any required tenure or promotion record in the Police Department; provided, however, that persons permanently appointed to the Department who shall have served as "Probationary Patrol Officer" shall be entitled to credit for service during their probationary periods.

a. 
Escort Service by Department. The Police Department shall provide escort service to any business or industry in the Borough, at the request of the business or industry, in the transportation of money or other valuables within the Borough.
b. 
Service Supervised by Chief of Police. The service shall be provided as scheduled and directed by the Chief of Police.
c. 
Service Fee. The fee to be paid to the Borough for each such escort service shall be the sum of $2 if the distance for which the escort service is provided shall be less than one mile, and shall be the sum of $5 if the distance for which the escort service is provided shall be in excess of one mile. All fees for such escort service shall be paid to the Borough Clerk.
d. 
Exemptions from Fees. No charge shall be made to any charitable or religious organization, association or corporation for such escort service.

The fee for Police Officers serving as traffic directors for construction and road detail work and other matters shall be the overtime rate for the said officer and for administrative fees and vehicle use the sum of $13 per hour per vehicle.

a. 
Assignment. The Chief of Police shall assign an officer to the position of Supervisor of Investigations. This Officer may be of any rank chosen by the Chief.
b. 
Duties. The Supervisor of Investigations shall be responsible for the day-to-day operation of the Detective Bureau/Investigation (other than motor vehicle), maintaining control of all evidence, preparing cases for trial and supervision of any subordinates assigned to the Detective Bureau. The Chief of Police shall also prescribe any other duties for the Supervisor of Investigations.

The Chief of Police shall appoint one or more officers to the rank of Detective. Detectives shall be responsible for all criminal investigations, maintaining control of evidence, preparing cases for trial and enforcing all laws of the State of New Jersey and Borough of Ringwood. The Chief of Police or the Supervisor of Investigations shall prescribe any other duties for Detective.

There is hereby established a Fire Department for the Borough to consist of the Ringwood Borough Volunteer Fire Company 1, the Erskine Lakes Volunteer Fire Company 1, and the Skyline Lakes Volunteer Fire Company.

Prospective members of the fire companies shall make application directly to the individual fire company in which membership is sought. Upon the successful completion of probationary period, as shall be determined by the company to which application was made, the applicant shall become a member in good standing in the company, and the applicant's name shall be entered on the roll of firefighters kept by the Municipal Clerk.

Every member of a fire company which is part of the Fire Department of the Borough of Ringwood shall, in each and every year, perform at least 60% of the duty to be composed of actual attendance and duty at fires and drills and a record shall be kept of such attendance and duty by the Chief of each company. The Chief shall report annually the names of the members who have met this standard to the Municipal Officials.

Exemption certificates may be issued to members of the fire companies which are part of this Department who shall have served seven years in active duty as required by law.
