The Council may create such other nondepartmental boards and agencies as it may deem desirable.

Nonstatutory boards, agencies and commissions shall be advisory to the Council, the Manager, and/or Borough Departments as appropriate, and shall be provided staff assistance, on approval/direction of the Manager, when needed and available within appropriated funds. A member of Council may be appointed as liaison to each advisory board.

A Board of Health of the Borough of Ringwood is hereby created and established.

The Board of Health shall have the powers set forth in N.J.S.A. 26:3-1 et seq.

The Board of Health shall consist of seven members appointed by the Council. Each Board member shall hold office for a term of three years except in the case of vacancies. Each vacancy shall be filled for the unexpired portion of the term only.

The Board shall adopt rules and regulations for its own government and issue directives to members of the Department of Health, subject to the regulation of the Borough Manager with respect to the assignment, hiring, firing and general administrative control of personnel and subject to Borough practices regarding expenditures and fixing of salaries.

The Board of Health shall elect a President and Vice President from among its members. It shall also appoint a Secretary for the Board. An employee of the Borough may not be selected as Secretary without approval of the Borough Manager.

a. 
Established. A Board of Recreation Commissioners of the Borough is hereby created and established.
b. 
Administration. The Board shall adopt rules and regulations for its own government and shall be subject to the general direction of the Borough Manager.
c. 
Employees. All employees of the Recreation Department shall be hired by and shall be accountable to the Borough Manager.
d. 
Composition; Terms; Alternate Members.
1. 
The Board shall consist of seven persons who shall be residents of the Borough and shall be appointed for such terms as provided by law.
2. 
The Board shall additionally consist of two alternate members designated as Alternate No. 1 and Alternate No. 2. The first term of Alternate No. 1 shall be five years and the first term of Alternate No. 2 shall be four years. Thereafter, all terms shall be for five years.
3. 
No Alternate Members shall be permitted to act on any matter in which the Alternate has either directly or indirectly any personal or financial interest. An Alternate Member may, after public hearing if he/she requests one, be removed by the Governing Body for cause.
4. 
Alternate Members may participate in discussions of the proceedings but may not vote except in the absence or disqualification of a regular member of the Board of Recreation Commissioners. A vote shall not be delayed in order that a regular member may vote instead of an Alternate Member. In the event that a choice must be made as to which Alternate Member is to vote, Alternate No. 1 shall vote.
e. 
The Board of Recreation Commissioners shall not have the power or authority to acquire real property in its own name, and shall not have the power to issue any bonds or any other evidence of indebtedness.

There is in and about the Borough a need to provide for the planning, development, protection, use and maintenance of all environmental resources contained within the territorial limits of said Borough.
N.J.S. 40:56A-1 et seq. provides the enabling legislation whereby a municipality may create by ordinance an Environmental Commission to conduct research into the use of open land areas within the Borough, acquire property in the name of and with the approval of the Governing Body, keep an index of all open lands and take other such steps as it deems fit to fulfill its responsibilities.
The Environmental Commission may make recommendations such as, but not limited to, those concerning open space preservation, water resource management, air pollution control, solid waste management, noise control, soil and landscape protection and environmental appearance to the Borough or any constituted agency of the Borough.
The Borough Council has decided that it is in the best interest of the Borough and its inhabitants that an Environmental Commission be created to serve as an agency of the Borough and provide for its environmental protection.

a. 
Pursuant to the provisions of An Act Authorizing Municipalities to Establish Environmental Commissions and Supplementing Title 40 of the Revised Statutes (N.J.S. 40:56A-1 et seq.), an Environmental Commission is hereby created.
b. 
The Commission shall have all the power and duties as provided for by N.J.S. 40:56A-1 et seq. and any other statutes hereafter enacted and applicable thereto subject to the approval of the Mayor and Governing Body.

The Mayor shall appoint the members of the Environmental Commission, which shall consist of seven persons, citizens, and residents of the Borough, one of whom shall also be a member of the Borough Planning Board.
The Mayor shall designate one of the members to serve as Chairman and Presiding Officer of the Commission.
Each Commissioner shall be appointed for a term of three years and until appointment and qualification of his successor.
The Mayor or the Borough Council may remove any members of the commission for cause, on written charges served upon the member and the member so charged shall be entitled to be heard in person or by counsel. A vacancy on the Commission occurring otherwise than by expiration of a term shall be filled for the unexpired term in the same manner as the original appointment.
All members of the Commission shall serve without compensation.

The Environmental Commission shall keep records of its meetings and activities and shall make an annual report to the Borough Council.

The Borough Council may appropriate funds for the expenses incurred by the Environmental Commission.

There is hereby established an Economic Development Commission of the Borough of Ringwood.

It shall be the purpose of the Economic Development Commission:
a. 
To inquire into, survey and publicize the extent, advantages and utility of vacant and occupied lands of the Borough, whether publicly owned or otherwise, for economic development;
b. 
To advertise the economic advantages and opportunities of the Borough and to encourage and accomplish economic development within the Borough;
c. 
To solicit for purchase or lease the various lands and properties of the Borough for economic development;
d. 
To advise the Municipal Council, Planning Board and other municipal entities on policies, rules and regulations and procedures to enhance and encourage economic development and to comment on applications before such entities; and
e. 
To perform such functions and duties as may be assigned by the Municipal Council.

The Commission shall consist of seven members who shall be appointed by the Borough Council for a term of five years. Vacancies in the membership may be filled by the Borough Council for the unexpired term. The members of the Commission shall choose annually from among its members, a chairman and other officers, as it may deem necessary. A majority of the members shall constitute a quorum.

Subject to the approval of the Manager, the officials, officers and employees of the Borough shall assist the Commission where necessary to carry out its functions. The Commission may employ such persons as necessary to perform clerical functions. The Borough Council may annually appropriate such sums as may be reasonably necessary to conduct the operations of the Commission. The Commission shall keep accurate records of its accounts.

The Commission shall make an annual report to the Borough Council setting forth its operations and transactions for the preceding 12 months.

There is hereby established an Open Space, Conservation, Recreation, Farmland and Historical Advisory Committee (hereinafter "the Committee").

a. 
The Committee shall consist of:
1. 
The Mayor; and
2. 
Two Council Members appointed by the Council; and
3. 
The Chairpersons of the Planning Board, Board of Adjustment, Environmental Commission, Recreation Commission.
4. 
Four "at large" members of the general public, who shall be residents of the Borough, but not serving as a representative of any other board or commission.
b. 
The Chairperson of the Planning Board, Board of Adjustment, Environmental Commission or Recreation Commission may designate a member to attend meetings and act in his/her place and stead.
c. 
The Councilmembers shall serve for a term of one year or until their Council term expires, whichever occurs first.
d. 
The initial four "at large" members terms shall consist of the following: 1) one current member with a term that does not expire until December 31, 2007, 2) one appointed member with a term that expires on December 31, 2007, and 3) two appointed members with two year terms that expire on December 31, 2008.
e. 
After the expiration of any "at large" terms, "at-large" members shall be appointed to a term of three years and such appointments shall be staggered such that only two of the four at-large members are appointed for any of the same three year terms.
f. 
Vacancies in the membership appointed by the Council shall be filled by appointment by the Council for the unexpired terms.

The members of the Committee shall choose annually from among its members a Chairperson and such other officers as it may deem necessary. A majority of the members shall constitute a quorum of the Committee. The Committee shall adhere to, and be governed by, the provisions of the Open Public Meetings Act.

The Committee shall inquire into and make recommendations to the Council about matters pertaining to the acquisition, maintenance, development and preservation of the lands for open space, recreation, conservation, farmland and historical purposes; cooperate with other relevant governmental and nongovernmental organizations in formulating its recommendations; and perform such other duties as assigned by the Council.

a. 
Establishment. There is hereby established a fund to be designated: "Trust Fund for Open Space, Conservation, Recreation, Farmland and Historical Purposes."
b. 
Authority of Council. The Municipal Council is hereby authorized to acquire, maintain, develop and preserve lands for open space, conservation, recreation, farmland and historical purposes and to determine the amount of funds to be made available for such purposes. The Municipal Council may proceed by way of gift, purchase or by eminent domain proceeding to effectuate the aforesaid purposes.
c. 
Funding. The Trust Fund shall be funded through the dedication to the Trust Fund an amount equal to $0.01 per $100 of assessed valuation of each annual tax levy. The Trust Fund may accept gifts, bequests and devices. The funds accumulated within the Trust Fund shall be used for the purposes aforesaid and may be used as a down payment for the issuance of notes or bonds.
d. 
Disposition of Property. No property, easement or other interest in property acquired by the Trust Fund shall be sold or conveyed unless and until authorized by a binding public referendum.

A group of citizens dedicated to the sustainability of the community and known as the Green Team, appointed by the Municipal Council, is hereby established as an advisory committee.
a. 
The Green Team shall report to the Municipal Council and Municipal Manager and generally have the following duties, subject to the more specific instructions or limitations.
b. 
The general purposes for the Green Team shall include but not limited to:
1. 
Manage the Borough of Ringwood's participation in the "Sustainable Jersey" program;
2. 
Encourage the Borough staff to pursue sustainable practices where possible and implement the governing body's environmental goals;
3. 
Work with existing groups within the Borough whose actions affect environmental issues so as to eliminate duplication and assure that important tasks are covered;
4. 
Coordinate input and provide management for the Green Team section of the Borough website;
5. 
Provide suggestions for further research and action to the Municipal Council;
6. 
Provide advice and suggestions to the Borough Planning Board, Board of Adjustment, the Environmental Commission, the Recreation Commission and all other boards and committees to assure that environmental issues are considered in their deliberations and actions;
7. 
Solicit and evaluate environmental ideas and suggestions from the community;
8. 
Promote the causes of sustainability within the Borough;
9. 
Educate and encourage all municipal employees, residents and businesses to participate in Green initiatives;
10. 
Collaborate with public and private Green committees to ensure the replication of best practices and to insure a coordinate effort within the Borough of Ringwood and with neighboring communities.
a. 
The Green Team shall consist of seven regular members appointed by the Municipal Council, all of whom shall be residents of the Borough, provided, however, the regular membership shall consist of at least four of the following persons:
1. 
One member from the Municipal Council;
2. 
One member from the Ringwood Environmental Commission;
3. 
One member from the Board of Health;
4. 
One member from the Economic Development Commission;
5. 
One member who resides in the area designated by the United States Environmental Agency as the Ringwood Mines/Landfill area;
6. 
One member from a nonprofit entity situated in the Borough of Ringwood.
b. 
The term of office for regular members shall be for two years as follows: One block of four initial appointees shall serve two years (Block A), and thereafter appointees in Block A shall serve two years, and one Block of three initial appointees shall serve one year (Block B) and thereafter appointees in Block B shall serve two years.
c. 
Alternate Members. The Municipal Council may also appoint not more than three alternate members who shall be municipal residents. Alternate members shall be designated at the time of appointment as "Alternate No. 1; Alternate No. 2 and Alternate No. 3." The term of the alternate members shall be two years, except that Alternate No. 3 shall be appointed for an initial term of one year and thereafter the appointment of Alternate No. 3 shall be for two years. An alternate member shall participate in the absence or disqualification of a regular member.
d. 
The Green Team shall annually select one member as Chairperson and a second member as Vice Chairperson, the terms of which shall be one year.
e. 
All members shall serve without compensation.
f. 
Vacancies in the regular membership and alternate membership shall be filled for the unexpired term. Any member from Subsections a1, 2, 3 and 4 above who no longer holds the stated position will be deemed to have vacated his/her position on the Green Team.
a. 
The initial organization of the Green Team shall occur within 15 days of the appointment of members pursuant to this section. Thereafter, the Green Team shall organize annually within 15 days of January 1 of each year. Minutes shall be taken of each meeting and submitted to the Municipal Council. Meetings shall be conducted in accordance with Roberts Rules of Order and shall be subject to the provisions of the Open Public Meeting Act.[1]

b. 
No action shall be taken at any meeting without a quorum being present. All actions shall be taken by an affirmative majority vote of the members present at the meeting. A quorum shall consist of at least four members.
c. 
The Green Team shall meet at least once a month.
d. 
Additional meetings of the Green Team may be scheduled by the Chair at his/her discretion.
If any section, subsection, sentence, clause or phrase of this section is for any reason held to be unconstitutional or invalid, such decision shall not affect the remaining portions of this section, which shall otherwise remain in full force and effect.
All ordinances or parts of ordinance inconsistent herewith are hereby repealed to the extent of such inconsistency.
This section shall take effect 20 days after final passage as provided by law.
