As used in this section:
CAT
Shall mean any member of the domestic feline species; male
and female, whether neutered or spayed.
CAT OF LICENSING AGE
Shall mean any cat which has attained the age of three months,
or which possesses a set of permanent teeth, whichever comes earlier.
HARBOR
Shall mean to provide shelter or refuge.
LICENSING OFFICIAL
Shall mean and refer to the official designated by the Borough
Health Department to license cats within the Borough.
MAINTAIN
Shall mean to provide a source of food.
NEUTERED
Shall mean to render permanently incapable of reproduction
as certified by a licensed veterinarian.
OWNER
When applied to the proprietorship of an animal, shall mean
and include every person having a right of property (or custody) in
such a cat and every person who has such cat in his/her keeping, or
who harbors or maintains a cat or knowingly permits a cat to remain
on or about any premises occupied by that person.
OWNER'S PREMISES
Shall mean and include the building and/or plot of land on
which the building stands in which the owner of a cat has a residence
or place of business in the Borough.
PERSON(S)
Shall mean an individual, family, firm, partnership, corporation,
association of persons, or institution commonly recognized by law
as a unit.

No person shall keep, harbor or maintain any cat within the
Borough without first obtaining a license therefore, to be issued
by the licensing official upon application by the owner and payment
of the prescribed fee; and no person shall keep, harbor or maintain
any cat except in compliance with provisions of this section.

Any person who owns, keeps, harbors, maintains or suffers the
keeping or harboring of any cat of licensing age within the Borough
shall annually apply to the Health Department for a license and official
registration tag for each cat owned, kept, harbored or maintained.
The owner shall place upon each cat a collar or other device with
the license number securely fastened or displayed thereto. Acceptable
methods of displaying license number shall include, but not be limited
to, break-away collars or elastic collars.

a. The person applying for an annual license and registration tag shall
pay a fee of $5 for each neutered cat and $8 for each unneutered cat
and the fee for each annual renewal will be the same.
b. License and registration tag for each cat owned shall be purchased
beginning January 1, 1994. Licenses, registration tags and renewals
thereof shall expire on the 31st day of January of the following year.
c. From February 1st to March 31st there shall be an additional late
registration fee in the amount of $5 but applicant shall not be subject
to summons. Thereafter, in addition to the fee and late registration
fees, an applicant shall be subject to summons and fine unless the
fees be paid voluntarily prior to the issuance of a summons.

Only one license and registration tag shall be required in any licensing year for any cat owned in New Jersey, and such license and tag issued by any other municipality of this State shall be accepted by the Borough as evidence of compliance with subsections
BH6-1.3 and
BH6-1.4.

The owner of any newly-acquired cat of licensing age or of any
cat which attains licensing age shall make application for license
and registration tag for such cat within 10 days after such acquisition
or age attainment.

Any person who violates or who fails or refuses to comply with
the provisions of this section shall be issued a Court Summons, shall
be required to comply with the provisions of this section and upon
conviction, be subject to a fine of not less than $5 nor more than
$50 for the first offense, applicable fees and a fine of not less
than $5 nor more than $10 for the second offense and applicable fees
and a fine of not less than $10 and a maximum of $500 for each offense
thereafter.

As used in this section:
COMPLIANCE OFFICIAL
Shall mean and refer to officials of the Borough Health Department
and Police Department.
FEE OR FEEDING
Shall mean the act of or the furnishing of food or other
sustenance which is essential for growth or maintenance.
PERSON(S)
Shall mean an individual, family, firm, partnership, corporation,
association or persons, or institution commonly recognized by law
as a unit.
WATERFOWL
Shall mean any member of the species of birds, commonly known
as swans, geese, brants, river and sea ducks, sea gulls and any other
waterfowl falling under the jurisdiction of the State of New Jersey
Department of Fish, Game and Wildlife or otherwise defined.

It shall be unlawful for any person to feed or permit the feeding
of any waterfowl within the Borough.
