[HISTORY: Adopted by the Mayor and Council of the Borough of Montvale 4-14-1981 by Ord. No. 81-730 (Ch. 98 of the 1966 Code). Amendments noted where applicable.]
As used in this chapter, the following terms shall have the meanings indicated:
DEALER
Any person, partnership or corporation who, through any means, buys or sells secondhand gold, silver, precious metals or jewelry, but not limited thereto, and includes anyone advertising the purchase or sale of any of the aforementioned items.
MINOR
Any person under the age of 18 years.
A. 
License required. No person shall buy, sell or dispose of secondhand gold, silver, precious metals or jewelry within the Borough of Montvale without first obtaining a license thereof.
B. 
Application. Any person desiring to obtain a license for the purpose heretofore mentioned in this chapter shall apply therefor, in writing, to the Chief of Police of the Borough on an application blank containing the following information and complying with the provisions thereof:
(1) 
The name and permanent address of the applicant.
(2) 
If the applicant is a corporation, partnership or other business entity, the names and addresses of each person having more than a 10% interest in the applicant.
(3) 
The address of the applicant's place of business within the Borough of Montvale and any other business locations of the applicant.
(4) 
The applicant's photograph and fingerprints.
C. 
License period. All licenses shall be issued for the period of January 1 through December 31 of each year.
D. 
License fee. The applicant shall pay an annual fee of $200.

A. 
Records required. Each dealer shall maintain for five years a complete record of each purchase and sale, including the amount paid, indicating the name, residence, occupation, age, description and signature of the person from whom the item was purchased, received or sold.

B. 
Inspection of records. These records shall be subject to the inspection of any authorized police officer of the Borough of Montvale during the course of any valid investigation.

Notification of purchase or sale shall be required. Each licensed dealer shall deliver to the Montvale Chief of Police, on a weekly basis, the detailed description of all items purchased, received or sold on forms prescribed by the Chief of Police.
A. 
Prohibited transactions. No person shall purchase, sell, melt, change the form of or dispose of any secondhand gold, silver, precious metals or jewelry within the Borough of Montvale without first obtaining a license.
(1) 
Flea markets, bazaars, etc. No dealer shall purchase secondhand gold, silver, precious metals or jewelry at a flea market, bazaar, etc., held in the Borough of Montvale.
(2) 
No dealer shall conduct business within or on the premises of any designated hotel, motel or any other place for the purpose of buying or selling any secondhand gold, silver, precious metals or jewelry, without a valid certificate of occupancy for operating such a business.
B. 
Prohibited actions. No dealer shall sell, melt, change the form of or dispose of any articles purchased or received within 10 days from the date the notification is made to the Montvale Chief of Police.

C. 
Removal prohibited. No dealer shall remove any secondhand gold, silver, precious metals or jewelry purchased or received from their premises for at least 10 days from the date the notification is made to the Montvale Chief of Police, unless otherwise confiscated by the Chief of Police as evidence in a criminal proceeding, at which time a receipt shall be issued describing the article.

D. 
Transactions with minors prohibited. No dealer or other persons shall sell or dispose of any secondhand gold, silver, precious metals or jewelry to any minor or purchase or receive any secondhand gold, silver, precious metals or jewelry from any minor.

Each dealer must require a valid state- or federal-issued driver's license bearing a photograph or other government-issued form of identification bearing a photograph of the person with whom he is transacting business subject to this chapter.

Violations of this chapter shall be punished as set forth in Chapter 1, Article I, General Penalty.
This chapter shall take effect upon publication and final passage as provided by law.
