A person or organization desiring to hold any special event
in or upon any public grounds or private property within the Borough
must first apply for and obtain a permit from the Borough Zoning Official
in accordance with the requirements of this chapter.
As used in this chapter, the following words shall have the
meanings indicated:
A concert, race, walkathon, fair, carnival, festival, celebration,
show, or other similar event, as well as the closing of a public street,
the blocking or restriction of public property, the sale of merchandise,
food, or beverages on public property or on private property where
otherwise prohibited by ordinance. The term shall also include the
installation of a stage, band shell, trailer, van, portable building,
grandstand or bleachers on public property, or on private property
where otherwise prohibited by ordinance. The term shall also include
placement of portable toilets on public property, or on private property
where otherwise prohibited by ordinance, or placement of temporary
no-parking signs on a public right-of-way.
All individuals or entities who intend to sell food, toys,
or any other service or product for profit, including all rides whether
electronically powered or not.
A permit for a special event shall only be given if the applicant
satisfies all of the following criteria:
A.Â
An application for a special event
permit must be completely filled out and filed with the Montvale Zoning
Official.
B.Â
The application must be filed
at least 14 calendar days prior to the special event start date. This
requirement may be waived for good cause shown.
C.Â
The application must specify the
duration of the permit, whether single-day, weekend (Friday, Saturday,
Sunday), week-long (any uninterrupted seven-day period), monthly (any
uninterrupted thirty-day period), or seasonal (any uninterrupted ninety-day
period).
D.Â
The applicant must supply a sketch
or rendering of the property where the proposed event will take place,
which indicates the locations of all proposed temporary structures
and identifies all vendors. The Zoning Official may, at his discretion,
require a survey of the property if deemed necessary for the safety,
health and welfare of the public.
E.Â
The application must be accompanied
by all applicable fees. Fees may be waived for a nonprofit event,
provided the applicant provides a 501(C) exemption form.
F.Â
The applicant must evidence compliance
with all other necessary prerequisites, including, without limitation,
any required food-handlers' permit from the Board of Health, fire
prevention permit, or Police Department notification.
The fees for a special event permit shall be as follows:
A.Â
All proposed vendors participating
in a special event must be identified on the permit application material
provided to the Borough Zoning Official.
B.Â
Vendors may not be located closer
than 50 feet to any permanent building or structure.
C.Â
No vendor may be located in a
manner that interferes with or prohibits emergency vehicles from accessing
the property or emergency personnel from accessing a building or structure.
No vendor shall impede the flow of pedestrian traffic, including the
handicapped, and said display shall in no way threaten the safety
of the public. This includes, but is not limited to, ensuring that
motorists are not visually or physically obstructed in an unsafe manner.
D.Â
All vendors offering food for
sale shall maintain a valid food-handling permit for the food or foodstuffs
displayed if the same are of the type which otherwise require a permit;
said vendor shall also provide a trash receptacle of at least 25 gallons
capacity within five feet of his/her display area.
A.Â
No more than two special event
permits may be issued to an applicant per calendar year with each
special event occurring no closer than 30 days from the end of the
last special event.
B.Â
The Borough reserves the right
to prohibit a special event and/or to restrict any aspect of a special
event if in its opinion the special event, or any part thereof, would
adversely impact or be detrimental to the safety, health and welfare
of the public.
C.Â
Special event permits shall not
be required for Borough-sponsored events or activities.
D.Â
Special event permits shall be
posted in a conspicuous location at the site of the event.
