It shall be unlawful for any person to harbor, maintain, keep,
control or have in his/her possession a wild, dangerous or undomesticated
animal within the territorial limits of the Borough of Neptune City.
A wild, dangerous or undomesticated animal shall be one which
is not a species customarily used as an ordinary household pet, but
one which would ordinarily be confined to a zoo, or one which would
ordinarily be found in the wilderness of this or any other country,
or one which otherwise causes a reasonable person to be fearful of
bodily harm or property damage. Animals included in this definition
include, but are not limited to, horses, gamecocks and other fighting
birds, monkeys, wolves, poisonous reptiles and snakes. Fish kept in
an aquarium and birds, rabbits, gerbils and hamsters kept in a cage
are specifically not included in this definition.
It shall be unlawful for any person to harbor, maintain, keep,
control or have in his/her possession certain domesticated animals,
including but not limited to, pigs, chickens, turkeys, roosters and
related poultry species, duck, geese and related fowl species and
deer and related species, not included in the definition of wild animal
above, within the territorial limits of the Borough of Neptune City.
A.
The provisions of this Article shall not apply to licensed pet shops,
menageries, zoological gardens and circuses, if:
(1)
Their location conforms to the provisions of the Zoning Ordinance
of the Borough of Neptune City;
(2)
All animals and animal quarters are kept in a clean and sanitary
condition and so maintained as to eliminate objectionable odors;
(3)
Animals are maintained in quarters so constructed as to prevent their
escape; and
(4)
No person lives or resides within 200 feet of the quarters in which
the animals are kept.
B.
The provisions of this Article shall not apply to those persons possessing
valid permits issued by the New Jersey Department of Environmental
Protection, Division of Fish, Game and Wildlife, for (1) rehabitating
birds of prey and non-game birds and/or (2) rehabitating game birds
and mammals.
The provisions of this Article are severable, and if any word,
sentence, section or other part of this Article should be found to
be invalid, such invalidity shall not affect the remaining provisions,
and the remaining provisions shall continue in full force and effect.
