It shall be unlawful within the Borough of Neptune City for any person, firm or corporation to engage in or carry on any of the businesses, trades or occupations enumerated in § 79-4 of this Article unless he, she, they or it first obtains a license for said purpose and pays therefor to the Borough of Neptune City the license fee hereinafter fixed for any such business, trade or occupation.
Application for such license, both new and renewal, shall be made to and said license shall be issued by the Borough Clerk, and no license shall be issued until payment of the fee for the same has been made. Every license application shall specify, by name, the person, firm or corporation to whom it is to be issued, the business, trade or occupation for which it is to be issued and the location at which such business, trade or occupation is to be carried on. The said license, when issued, shall specify by name the person, firm or corporation to whom it is issued, the business, trade or occupation for which it is issued and the location at which such business, trade or occupation is to be carried on.
All license fees shall be due and payable to the Borough of Neptune City at the Borough Office on the first day of January in each year, and all such licenses shall expire on the 31st day of December following. All licenses issued between the first day of September and the 31st day of December following in any year shall be issued for 1/2 of the fee fixed in § 79-4 hereof.

The license fees to be paid annually, as above provided, to the Borough of Neptune City for conducting or carrying on the business, trade or occupation herein named at the place to be designated in the license certificate issued thereof shall be as follows:

B. 
Mercantile fees are due by the first of January; if not paid within ninety (90), days a late fee of $50 will be charged.

The Chief of Police of the Borough of Neptune City or any police officer or police officers of the borough designated for that purpose by the Chief of Police shall have the right and authority to enter in and upon any licensed premises during reasonable hours of the day and make such inspection as may be necessary to determine that all laws of the State of New Jersey and all ordinances and regulations of the Borough of Neptune City are complied with, and the inspector of the Board of Health of the Borough of Neptune City shall have the right and authority to enter in and upon any licensed premises during reasonable hours of the day and make such inspection as may be necessary to determine that all health regulations of the State of New Jersey and the Borough of Neptune City have been complied with. If, upon such inspection, any violation or violations shall be found to exist, the Chief of Police, police officers, Board of Health Inspector or such other person as the Board of Health may have designated shall report such violation or violations to the Mayor or Council with respect to all violations, except those violations concerning the public health, and all public health violations to the Board of Health of the Borough of Neptune City, for such action as the Mayor and Council or the Board of Health, as the case may be, shall determine to be appropriate.
A. 
No license certificate shall be issued to any person or corporation who has not complied with the laws of the State of New Jersey or ordinances of the Borough of Neptune City. In the event that any person or corporation to whom a license under this Article shall have been issued commits, suffers or permits any violation of the laws of the State of New Jersey, the ordinances or regulations of the Borough of Neptune City or the health regulations of the State of New Jersey or the Borough of Neptune City, and such person or corporation shall fail to comply with such laws, ordinances and regulations after due notice of such violation and an opportunity to be heard, the governing body may revoke the license issued to such person or corporation. Upon revocation for cause, no part of any license fee shall be refunded.
B. 
No license authorized to be issued under the provisions of this Article shall be transferable, and no license shall cover any place of business other than that for which it was issued.

As used in this Article, the following terms shall have the meanings indicated:
BUSINESS
Includes businesses, trades, callings and vocations.
PERSON
Includes persons, firms, partnerships, corporations and limited liability companies.

It shall be unlawful to conduct any mercantile business or other business with the public upon any premises used for the same between the hours of 12:00 midnight and 6:00 a.m.
It shall be unlawful to keep open for the public or to admit the public to or permit the public to remain within any premises used as a mercantile or other business between the hours of 12:00 midnight and 6:00 a.m.

The provisions of Sections 79-9 and 79-10 shall not apply to the following:
A. 
Hotels and motels, gasoline stations or restaurants, taverns or stores whose primary purpose is the sale at retail of prepared meals or food and/or beverages for consumption on or off the premises of such restaurants, taverns or stores.
B. 
Businesses which provide entertainment or recreational uses such as arcades, billiard parlors, live theaters, movie theaters, or similar uses between the hours of 12:00 midnight and 2:00 a.m. prevailing time, provided that such businesses provide uniformed security at such premises to ensure public safety during such extended hours. This exception for such uses shall only be applicable during such extended hours. Any establishment maintaining and operating coin-operated dry-cleaning machines or coin-operated laundry machines shall provide an attendant who shall be in attendance at all times during which said establishment is open for business between the hours of 12:00 midnight and 6:00 a.m.
C. 
Any establishment whose primary purpose is solely maintaining and operating coin-operated car wash machines.
