All pools constructed and maintained in the Borough of Neptune City shall comply with the following Regulations and with the current edition of the BOCA National Building Code as adopted by N.J.A.C. 5:23-3.
No pool, wading pool and any accessory building shall cover more than 50% of the rear yard of the lot involved. The rear yard is designated and is defined in the Zoning Ordinance of the Borough of Neptune City.
No pool drain, wading pool drain or portable drain shall be connected into the sanitary sewer system. Pool water may not be discharged at the curb or upon the surface of any street. The discharge of said water shall in no case cause or create a nuisance to the abutting property or to the public.
A. 
No pool, wading pool or portable pool shall be constructed or installed within five feet of any side line or rear line, nor within eight feet of the rear of any dwelling unit as measured to the closest edge of the water; nor shall such pool be constructed or installed in the front yard or side yard of the property. The exact location of any of the above pools shall be at such place as is approved by the Building Inspector in conformity with the ordinance pertaining thereto. In the case of a corner lot, a pool shall not be constructed any nearer to the side street line than the prevailing setback line on that street, nor the required setback line for front yards, as set forth in the Zoning Ordinance.
B. 
A pool or wading pool shall not be constructed or installed on any premises unless a residence building is located on said premises or unless said premises is part of a residence curtilage.
Bacteriological standards shall comply with at least the minimum standards as set forth by the New Jersey State Board of Health.
A. 
Every pool, wading pool or portable pool constructed, installed, established or maintained in the Borough of Neptune City shall at all times comply with the requirement of the local Board of Health. Any nuisance or hazard to health which may exist or develop in or in consequence of or in connection with any such pool, wading pool or portable pool shall be forthwith abated and removed by the owner, lessee or occupant of the premises on which the said pool is located, upon receipt of notice from the Code Enforcement Officer or Health Officer of the Borough of Neptune City.
B. 
It shall be the duty of the Code Enforcement Officer and Health Officer to enforce the provisions of the chapter.
C. 
The owner or operator of any pool within the borough shall allow the said Code Enforcement Officer and Health Officer, or other authorized official, access to any pool, wading pool or portable pool and appurtenances thereto for the purpose of inspection to ascertain compliance with this chapter and all other pertinent borough ordinances at all reasonable times, either before or after a complaint is registered.
