This article shall be known and may be cited as the "Lower Windsor Township Office of Township Manager Ordinance."
The purpose of this article is to create the office of Township Manager pursuant to the express grant of authority to do so as set forth in the Second Class Township Code.[1]

As used in this article, the following terms shall have the meanings indicated:
BOARD
The Lower Windsor Township Board of Supervisors.
TOWNSHIP
The Township of Lower Windsor, York County, Pennsylvania.
The Township Manager (hereafter "Manager") shall be appointed for an indefinite term by a majority of all members of the Board. The Manager shall serve at the pleasure of the Board, and may be removed at any time by a majority vote of all its members. At least 30 days before such removal is to become effective, the Lower Windsor Township Board of Supervisors shall furnish the Manager with a written statement setting forth its intention of removal.
The compensation of the Township Manager shall be set by resolution of a majority of the Supervisors, and shall be paid out of the general fund of the Township.
The Township Manager shall give bond to the Township, with sufficient surety, in the amount directed by the Board of Supervisors, conditioned for the faithful performance of the duties of the office.
The powers and duties of the Manager including the following are subject to recall or modification by ordinance or resolution of the Board.
A. 
Shall supervise all Township employees, and shall be responsible for the administrative activities of all Township departments, including the Township police, and Police Departments.

B. 
Shall have the authority to hire, layoff suspend or terminate personnel as set forth by the organizational structure and management polices of the Board.
C. 
Prepare and submit to the Board a budget for each fiscal year and an explanatory budget message in such a timely fashion as will enable the Board to consider and adopt the budget and related tax ordinances according to the requirements of law. In preparing the budget, the Manager or an officer designated by him/her shall obtain from the head of each department, agency, board, or any qualified officer thereof estimates of revenues and expenditures and such other supporting data as required. The Manager shall review such estimates and may revise them before submitting the budget to the Board.
D. 
Be responsible for the administration of the budget after its adoption by the Board.
E. 
Shall submit to the Board, as soon as possible after the close of each fiscal year, a complete report on the finances and activities of the Township for the preceding fiscal year.
F. 
Shall fill such other Township offices, and shall be employed by the Township in such other capacities, as a majority of the Board may direct.
G. 
Shall attend all regularly scheduled and special meetings of the Board, shall prepare the agendas for all such meetings, and shall provide the information necessary for the Board to consider the items on such agendas at such meetings.
H. 
Shall keep the Board informed as to the state and conduct of Township affairs, submit periodic reports to them on the condition of Township finances, make such other reports to them at their request, and make such recommendations to them as deemed advisable.
I. 
Shall see that the provisions of all franchises, lease, permits and privileges granted by the Township are observed.
J. 
Shall attend to the letting of Township contracts, and shall supervise the performance and faithful execution of same, unless such duties are expressly imposed by law upon another Township officer.
K. 
Shall see that all money owed the Township is promptly paid, and that proper proceedings are taken for the securing and collecting of all Township claims.
L. 
Serve as purchasing office of Lower Windsor Township and purchase, in accordance with the provisions of the Pennsylvania Second Class Township Code,[1] all supplies and equipment for the agencies, boards, departments and other offices of Lower Windsor Township. The Manager shall keep an account of all purchases and shall, from time to time or when directed by the Board, make a full written report thereof. The Manager shall also issue rules and regulations, subject to the approval of the Board, governing the procurement of all municipal supplies and equipment.

M. 
Investigate and dispose of or designate an officer to investigate and dispose of all complaints regarding the Township services and personnel and to report to the Board thereon. All complaints regarding the Township services shall be referred to the office of the Manager.
N. 
Shall establish and properly maintain filing and record-keeping systems designed to promote the efficient administration of the business of the Township.
O. 
Administer the day-to-day operations of the Township government by direct administration or delegation of responsibility and authority for performance of assigned functions to Township staff.
P. 
Perform other duties as assigned by the Board in a formal job description.
Q. 
Enforce the ordinances and regulations of Lower Windsor Township.
If the Manager becomes ill or needs to be absent from the Township the duties of the Manager shall be performed, in his or her absence, by such person or persons as may be designated by the Board.
All ordinances or parts of ordinances or resolutions conflicting with the provisions of this article are hereby repealed to the extent of such conflict.
If any section, subsection, paragraph, sentence, clause or phrase of this article shall be declared invalid for any reason whatsoever, such decision shall not affect the remaining portions of this article, which shall remain in full force and effect, and for this purpose, the provisions of this article are hereby declared severable.
This article shall become effective five days after date of adoption as provided by law.
