A certain document, one (1) copy of which is on file in the office of the City Clerk of the City of Platte City, being marked and designated as the International Swimming Pool and Spa Code, 2018 Edition, as published by the International Code Council be and is hereby adopted as the Swimming Pool and Spa Code of the City of Platte City, in the State of Missouri, for regulating and governing the design, construction, movement, renovation, replacement, repair and maintenance of swimming pools, spas, hot tubs, aquatic facilities and related equipment as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Swimming Pool and Spa Code on file in the office of the City of Platte City are hereby referred to, adopted, and made a part hereof, as if fully set out in this Article, with the additions, insertions, deletions and changes, if any, prescribed in Section 500.610 of this Article.

A. 
The following Sections of the International Swimming pool and Spa Code adopted in this Article are hereby revised:
1. 
[A] 101.1 Title. Insert:
These regulations shall be known as the Swimming Pool and Spa Code of the [City of Platte City] hereinafter referred to as "this code."
2. 
[A] 103.1 Creation of enforcement agency. Amend:
The Department of Code Enforcement for the City of Platte City is hereby created and the official placed in charge to implement, administrate and enforce the provisions of this code shall be known as the City Code Official.
3. 
[A] 105.6.1 Work commencing before permit issuance. Amend:
Any person who commences any work on a pool or spa system before obtaining the necessary permits shall be subject to a fee [double] the required permit fee.
4. 
[A] 105.6.2 Fee schedule. Amend:
The fees for all swimming pool and spa work shall be as indicated in the following fee schedule established in Section 500.510 of the Platte City Municipal Code.
5. 
[A] 105.6.3 Fee refunds. Amend:
The City Code Official shall authorize the refunding of fees if deemed erroneously paid or collected.
6. 
[A] 107.4 Violation penalties. Deleted and replaced:
Replaced with Platte City Municipal Code Section 500.640.

[A] 107.5 Stop work orders. Amend:
Upon notice from the Code Official, work on any system that is being done contrary to the provisions of this code or in a dangerous or unsafe manner shall immediately cease. Such notice shall be in writing and shall be given to the owner of the property, or to the owner's authorized agent, or to the person doing the work. The notice shall state the conditions under which work is authorized to resume. Where an emergency exists, the Code Official shall not be required to give a written notice prior to stopping the work. Any person who shall continue any work in or about the structure after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be guilty of a misdemeanor, punishable as provided in Section 500.640 of the City of Platte City Code of Ordinances.
8. 
[A] 102.11 Easements and setbacks. Addition:
In no case shall a swimming pool, spa or accessory structure to a swimming pool or spa be installed within an easement. Swimming pool and spas including their accessory structures must meet the established yard setbacks of the adopted Municipal Code.
9. 
320.1 Backwash water or draining water. Amend:
Backwash water and draining water shall be discharged to the storm sewer or into an approved disposal system on the premise, or shall be disposed of by other means approved by the authority having jurisdiction. Direct connections shall not be made between the end of the backwash line and the disposal system. Drains shall discharge through an air gap.

320.1.1 Wastewater prohibited disposal. Addition:
No backwash water or draining water shall be discharged, disposed of or allowed to be directed onto or across an adjacent property. Pool water shall be discharged at a slow rate or at intervals to reduce saturation, ponding, flooding and property damage.

Deleted code sections. The following code sections of the 2018 International Swimming Pool and Spa Code have been omitted and not hereby incorporated:

305.4 Structure wall as a barrier

Nothing in this Article or the International Swimming Pool and Spa Code hereby adopted shall be construed to affect any suit or proceeding impending in any court; or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in Section 500.600 of this Article; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this Article.

All other ordinances or parts of ordinances in conflict herewith are hereby repealed.

Any person who shall violate a provision of the code adopted in this Article or shall fail to comply with any of the requirements thereof or who shall erect, construct, alter or repair a building or structure in violation of an approved plan of or directive of the Code Official, or of a permit or certificate issued under the provision of this code, shall be guilty of a misdemeanor, punishable by a fine as follows: for municipal ordinance violations committed within a twelve-month period beginning with the first violation: two hundred dollars ($200.00) for the first municipal ordinance violation, two hundred seventy-five dollars ($275.00) for the second municipal ordinance violation, three hundred fifty dollars ($350.00) for the third municipal ordinance violation, and four hundred fifty dollars ($450.00) for the fourth and any subsequent municipal ordinance violations; Each day that a violation continues after due notice has been served shall be deemed a separate offense.
