The purpose of this chapter is to ensure the continued maintenance of, and the removal of snow and ice from, private community roadways and unadopted roadways in the Township and to provide penalties for the violation of the provisions of this chapter.
The following words, when used in this chapter, shall have the meanings ascribed to them in this section, except in those instances where the context clearly states otherwise:
BOARD
The Board of Supervisors of Lower Windsor Township.
CODE OFFICIAL
The Code Official for purposes of this chapter shall be the Zoning Officer of Lower Windsor Township or his or her officially designated representative, or the Police Chief of Lower Windsor Township or his or her officially designated representative.
ENGINEER
The Engineer employed by Lower Windsor Township.
PERSON
Every natural person, association, partnership, limited-liability company, corporation, or entity of any kind.
POLICE CHIEF
The duly appointed Police Chief of Lower Windsor Township.
PRIVATE COMMUNITY ROAD
Any road or thoroughfare designed for, or significantly used by, vehicular traffic, which road or thoroughfare is privately owned and maintained and that has not been adopted by Lower Windsor Township or the Commonwealth of Pennsylvania, and which is primarily used by residents of a private community such as an apartment complex, a condominium complex, a mobile or modular home park or community, or any other similar community, in which residents rely on the private community road to access their residence or dwelling, but not including those areas dedicated to parking, such as a parking lot, of such communities.
ROADWAY
For the purposes of this chapter, any private community road or unadopted street shall be considered to be a roadway.
TOWNSHIP
Lower Windsor Township, York County, Pennsylvania.
UNADOPTED STREET
Any street that is identified on a subdivision and/or land development plan approved by the Lower Windsor Township Board of Supervisors as a street dedicated to the Township by the developer for public adoption which street has not yet been accepted by the Township as a public street.
ZONING OFFICER
The duly appointed Zoning Officer of Lower Windsor Township.
