[HISTORY: Adopted by the Mayor and Borough Council of the Borough of Seaside Park 4-28-2022 by Ord. No. 2022-04. Amendments noted where applicable.]
There is hereby established a Department of Code Compliance in and for the Borough of Seaside Park and the position of Code Compliance Supervisor shall be the head of the Department.
The Department of Code Compliance shall:
A. 
Ensure compliance with various municipal ordinances, as well as resolutions of the Borough Planning Board and Zoning Board of Adjustment.
B. 
Initiate and enforce rules and regulations in relation to enforcement of ordinances and the resolutions of the Borough Planning Board and Zoning Board of Adjustment.
C. 
Initiate necessary legal action against violators of various municipal ordinances.
D. 
Prepare needed reports, establish and maintain records and files, and assist in the promulgation of municipal ordinances.
E. 
Enforce the zoning ordinances of the Borough.
F. 
Issue zoning permits.
G. 
Issue flood hazard letters when requested.
H. 
Answer all inquiries with regard to zoning and planning.
I. 
Keep a record of all applications for permits and of all permits and certificates issued, with a notation of all special conditions involved.
J. 
File and safely keep copies of all plans submitted pertaining to land use within the Borough.
K. 
Collect and record fees for zoning permits and flood hazard letters.
A. 
Appointment. The executive and responsible officer of the Department of Code Compliance in the Borough of Seaside Park shall be known and designated as the "Code Compliance Supervisor" who shall be appointed by the Mayor with the advice and consent of Council. The Supervisor shall report directly to the Borough Business Administrator. The Code Compliance Supervisor shall serve at the pleasure of the Borough Council.
B. 
Duties of Code Compliance Supervisor.
(1) 
Oversees all personnel and operations of the department.
(2) 
Supervises and oversees the code enforcement official, construction officials and subcode officials and zoning official.
(3) 
Plans, coordinates, staffs, prioritizes, monitors, directs, evaluates and participates in the Borough's code enforcement activities, involving zoning ordinances, housing codes, public nuisances, property maintenance, abandoned vehicles, license regulations and other issues relating to health, safety and welfare of the community; ensures safe work practices, work quality and accuracy.
(4) 
Assures that assigned areas of responsibility are consistent with local, state and federal regulations; stays current on related policies, regulations and trends.
(5) 
Participates in the development of policies and procedures; develops and recommends programs and projects.
(6) 
Participates in the selection and training of personnel; assumes responsibility for motivating and evaluating assigned personnel; provides necessary training; initiates discipline procedures as is appropriate.
(7) 
Develops schedules and methods for performing assigned duties; assigns work to staff; monitors work activities to ensure safe work practices, work quality and accuracy; ensures compliance with applicable rules, policies and procedures; maintains appropriate work records and documents which may include time sheets and work orders; prepares statistical and/or analytical reports on operations as necessary.
(8) 
Participates in the development of assigned budget; administers and monitors the approved budget; maintains supply inventories and supply and budgetary records.
(9) 
Addresses and responds to service questions, inquiries and complaints; establishes and maintains a customer orientation with assigned department.
(10) 
Establishes positive working relationships with representatives of community organizations, state/local agencies and associations, Borough management, staff, and the public.
(11) 
Performs related duties and responsibilities as assigned.
C. 
Qualifications. The qualifications necessary for a person to be appointed to the position of Code Compliance Supervisor shall be as follows:
(1) 
Education:
(a) 
Graduation from an accredited college or university with a bachelor's degree.
(b) 
Applicants who do not meet the educational requirement may substitute additional work experience as described below, on the basis of one year of such experience being equal to 30 semester hour credits.
(2) 
Experience:
(a) 
Two years of experience in zoning involving the issuance of permits and enforcement of zoning ordinances and regulations.
(b) 
Possession of a master's degree in business administration from an accredited college or university may be substituted for one year of the above-required work experience.
A. 
Creation of position. There is hereby established within the Borough of Seaside Park the position of Code Enforcement Officer within the Department of Code Compliance.
B. 
Duties of the Code Enforcement Officer. The Code Enforcement Officer shall have the following duties:
(1) 
Reports directly to the Code Compliance Supervisor.
(2) 
Responsible for enforcing the municipal ordinances and codes of the Borough.
(3) 
Responsible for reviewing the municipal ordinances of the Borough on a continuing basis and to making periodic reports to the department head or director, not less than once every six months, advising the department head or director as to recommendations for new ordinances or regulations or the amendment of existing ordinances or regulations of the Borough of Seaside Park.
(4) 
To attend all meetings of the Joint Land Use Board and other meetings as required by the Code Compliance Supervisor.
(5) 
To submit monthly reports to the Code Compliance Supervisor detailing work performance.
(6) 
To make investigations, serve violation notices, make and process complaints for code violations and make court appearances as necessary in connection therewith.
(7) 
To maintain files of all papers and records pertinent to work performance.
(8) 
To perform such other duties as may be prescribed by the Code Compliance Supervisor.
A.

B. 
Duties of the Code Enforcement Officer. The Code Enforcement Officer shall have the following duties:
(1) 
Reports directly to the Supervising Code Enforcement Officer.
(2) 
Responsible for enforcing the municipal ordinances and codes of the Borough.
(3) 
To attend all meetings of the Joint Land Use Board and other meetings as required by the Code Compliance Supervisor.
(4) 
To submit monthly reports to the Supervising Code Enforcement Officer detailing work performance.
(5) 
To make investigations, serve violation notices, make and process complaints for code violations and make court appearances as necessary in connection therewith.
(6) 
To maintain files of all papers and records pertinent to work performance.
(7) 
To perform such other duties as may be prescribed by the Supervising Code Enforcement Officer and Code Compliance Supervisor.
A. 
Creation of position. There is hereby established within the Borough of Seaside Park the position of Zoning Officer within the Department of Code Compliance.
B. 
Duties of the Zoning Officer. The Zoning Officer shall have the following duties:
(1) 
Reports to the Code Compliance Supervisor.
(2) 
To enforce the zoning ordinances of the Borough of Seaside Park.
(3) 
To issue zoning permits.
(4) 
To issue flood hazard letters in writing when requested.
(5) 
To answer all inquiries with regard to zoning.
(6) 
To keep a record of all applications for permits and of all permits and certificates issued, with a notation of all special conditions involved.
(7) 
To file and safely keep copies of all plans submitted.
(8) 
To collect and record fees for zoning permits and flood letters.
(9) 
To prepare a monthly report for the Mayor and Borough Council summarizing all activity of the previous months concerning the duties of the Zoning Officer.
(10) 
The Zoning Officer shall conduct field inspections and special investigations to ensure compliance with various municipal ordinances, initiate and enforce rules and regulations in relation to enforcement of ordinances, initiate necessary legal action against violators of various municipal ordinances, prepare needed reports, establish and maintain the records and files and may assist in the promulgation of municipal ordinances.
(11) 
Conduct field inspections and special investigations to ensure compliance with various municipal ordinances.
(12) 
Initiate and enforce rules and regulations in relation to enforcement of ordinances.
(13) 
Perform any other such function as necessary to administer the purpose of this department.
(14) 
Act as liaison to the Joint Land Use Board.
(15) 
Coordinate and advise the Borough as to zoning issues.
C. 
Administrative officer. The Zoning Officer shall be deemed to be the administrative officer as defined in N.J.S.A. 40:55D-3 and shall also issue certifications on behalf of the Borough of Seaside Park certifying whether or not a subdivision has been approved by the Seaside Park Borough Joint Land Use Board, in accordance with N.J.S.A. 40:55D-56 and, in general, shall coordinate the efforts of the Land Use Board of the Borough of Seaside Park and have such other duties or responsibilities as may, from time to time, be imposed with regard to the Land Use Board.
A. 
Creation of position. There is hereby established within the Borough of Seaside Park the position of Assistant Zoning Officer within the Department of Zoning.
B. 
Duties of the Assistant Zoning Officer.
(1) 
To assist the Zoning Officer to enforce the zoning ordinances of the Borough of Seaside Park.
(2) 
To perform all of the duties of the Zoning Officer at his or her direction or in his or her absence.
(3) 
To perform such other duties as may be prescribed by the Department of Personnel.
A. 
Creation of position. There is hereby established within the Borough of Seaside Park the position of Construction Code Official/Director of Inspections.
B. 
Appointment. The Construction Code official/Director of Inspections shall be appointed by the Mayor with the advice and consent of the Council. The Construction Code Official/Director of Inspections shall report directly to the Code Compliance Supervisor. Should the office become vacant during any term, it shall be filled by a similar appointment, but for the unexpired term only.
C. 
Responsibilities; duties. The duties and responsibilities are listed, and the Construction Code Official/Director of Inspections shall:
(1) 
Undertake enforcement proceedings for all building related codes, issuing and administering permits issued thereby and reviewing all site and construction plans as specified by state statute.
(2) 
Have, perform, and discharge all of the functions, powers, and duties prescribed by law for a construction official.
(3) 
Inspect real property and improvements thereon under the applicable code provisions, supervising the demolition of condemned buildings and performing such further duties prescribed by state statute.
(4) 
Administer the provisions of N.J.S.A. 52-27D-119 et seq., the State Uniform Construction Act, and N.J.A.C. 5:23-1 et seq., the regulations for the State Uniform Construction Code and the various subcodes provided therein, including but not limited to building subcode, plumbing subcode, and electrical subcode.
(5) 
Act as enforcing agent for the State Uniform Construction Code.
(6) 
Direct and supervise all personnel within the department.
(7) 
He or she shall render to the administration such reports, recommendations, or other documents as may be required, at regular stated intervals or on special request therefor. He or she shall hold himself or herself available for consultation and advice to all municipal officials and municipal boards or commissions and shall prepare and present to the administration short- and long-range recommendations for the improvement of the Borough in the areas within the functions and duties of his or her department.
(8) 
Directs, plans, organizes and supervises all inspection activities such as plumbing, electrical and building.
(9) 
Provides assignments to construction personnel.
(10) 
Assists in the preparation of the annual budget for the unit.
(11) 
Recommends policies or changes in policy and procedures to the Code Compliance Supervisor.
(12) 
Prepares and review annual and monthly reports on the activities of the unit.
(13) 
Directs the establishment and maintenance of records and files.
D. 
Qualifications. The qualifications necessary for a person to be appointed to the position of Construction Code Official shall be as follows:
(1) 
License: Must hold NJ Construction Code Official license.
(2) 
Experience:
(a) 
Must have three years of municipal construction official experience.'
(b) 
Must have five years of supervisory experience in enforcement of various municipal codes.
A. 
Within the Department of Code Compliance, under the direction of the Construction Code Official, there shall be an Assistant Construction Code Official.
B. 
Assists the Construction Official in overall administrative responsibility for administering and enforcing provisions of the New Jersey Uniform Construction Code and does other related duties as required.
A. 
Within the Department of Code Compliance, under the direction of the Construction Code Official, there shall Technical Assistants to the Construction Code Official (TACO).
B. 
Under the direction of the Construction Code Official, the Technical Assistants to the Construction Officials provide technical assistance in the issuance of Construction permits to ensure compliance with the provision of the New Jersey Uniform Construction Code and does other related duties as required.
A. 
Within the Department of Code Compliance, under the direction of the Construction Code Official, there shall be subcode officials. Subcode officials shall enforce the provisions of those subcodes for which they are responsible in accordance with Part II and qualified in accordance with Part IV of the State Uniform Construction Code and for which they have been appointed.
B. 
Each subcode official shall be responsible for the administration and enforcement of the appropriate subcode, subject to the procedures of the enforcing agency as administered by the construction official. However, each subcode official shall have exclusive decision-making authority with respect to the technical provisions of the subcode for which he or she has been appointed the official.
C. 
The subcode official shall enforce the State Uniform Construction Code and all applicable municipal ordinances and shall:
(1) 
Review those aspects of the application, plans and specifications appropriate to his or her subcode for approval and release to the construction official for issuance of the permit.
(2) 
Receive and review directly from the applicant applications for minor or emergency work for approval and release to the construction official for issuance of the permit.
(3) 
Comply with the time limitations for review as determined by the construction official.
(4) 
Review requests for variations as necessary.
(5) 
Perform all required inspections within three business days of the time for which inspection has been requested.
(6) 
Issue in the name of the enforcing agency notices of violation and notify the construction official of the same. The subcode official may issue verbal orders at the job site and shall record such orders in his or her inspection report.
(7) 
Complete reports of all inspections performed.
(8) 
Issue stop-work orders in the name of the enforcing agency and notify the construction official of the same.
(9) 
Perform final inspections and notify the construction official of approval in order that the construction official may issue a certificate of occupancy.
(10) 
Make inspection, review submitted date and notify the construction official of approval in the case of a change of use or a request for a certificate of continued occupancy.
(11) 
Assist the construction official in the preparation of all reports required by the State Construction Code.
(12) 
Attend meetings and hearings as required by the state regulations.
(13) 
Issue documentation and certification, such as cut-in cards, to utilities and/or public agencies if required by state regulations.
(14) 
Carry out such other functions as are necessary and appropriate to the position of subcode official.
A. 
Within the Department of Code Compliance, under the direction of the Construction Code Official, there shall be inspectors for building, electric plumbing. Inspectors shall inspect its various specialty to ensure compliance with the State Uniform Construction Code and enforces same to ensure public safety, health and welfare and does related work as required.
B. 
Each inspector shall be responsible to the subcode official and construction official or assistant construction official subject to the procedures of the enforcing agency as administered by the construction official.
A. 
Within the Department of Code Compliance, under the direction of the Code Compliance Supervisor, there shall be a Floodplain Manager as established pursuant to § 200-42L of the Code of the Borough of Seaside Park.
B. 
The Floodplain Manager shall be responsible for the duties set forth in § 200-42M of the Code of the Borough of Seaside Park.
A. 
Clerk:
(1) 
Position created. There is hereby created the position of Clerk for the Department of Code Compliance.
(2) 
Duties; qualifications. Under the supervision of the Code Compliance Supervisor, the Clerk shall perform routine clerical work of a varied nature.
