The Board of Commissioners for the Township of Tinicum does ordain as follows: That a certain document, complete copies of which are on file in the office of the Township Manager of the Township of Tinicum, for public use and inspection, being marked and designated as the International Fire Code, 2018 Edition, including Appendix Chapters "A" Board of Appeals, "B" Fire-Flow Requirements for Buildings, "C" Fire Hydrant Locations and Distribution, "D" Fire Apparatus Access Roads, "E" Hazard Categories, "F" Hazard Ranking, "G" Cryogenic Fluids-Wight and Volume Equivalents, "H" Hazardous Materials Management Plan (HMMP) and Hazardous Materials Inventory Statement (HMIS), "I" Fire Protection Systems-Noncompliant Conditions, "N" Indoor Trade shows and Exhibitions as published by the International Code Council be and is hereby adopted as the Fire Code of the Township of Tinicum, Delaware County, Pennsylvania, regulating and governing the safeguarding of life and property from fire and explosion hazards arising from the storage, handling and use of hazardous substances, materials and devices, and from conditions hazardous to life or property in the occupancy of buildings and premises as herein provided for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Fire Code on file in the offices of the Township of Tinicum are hereby referred to, adopted and made part hereof, as if fully set out in this legislation, with additions, insertions, deletions and changes, if any, prescribed in § 103-10 of this article.
The following are referenced to the section numbering system used by the 2018 International Fire Code ("IFC") and are hereby modified and amended as follows:
A. 
Section 101.1 Jurisdiction. The Township of Tinicum shall be inserted as the jurisdiction.
B. 
Section 101.2 Appointment. The Fire Code Official shall be the Tinicum Township Fire Marshall or such designee as duly appointed by the Board of Commissioners for the Township of Tinicum, Delaware County, Pennsylvania.
C. 
Section 105.1.1 Permits required. Permits required by this code shall be obtained from the Township of Tinicum Municipal Offices. Permit fees, if any, shall be paid prior to issuance of the permit and shall be paid to the Township of Tinicum and shall be deposited in the Township's General Fund. Issued permits shall be kept on the premises designated therein at all times and shall be readily available for inspection by the Fire Marshal or his designee. Operational permits are not required in the Township of Tinicum.
D. 
Section 109.3 or 109.4 Violation penalties. The violation penalties provision shall specify violations of the code as a summary offense, punishable by a fine of not more than $300 or by imprisonment not exceeding 10 days or both such fine and imprisonment.
E. 
Section 111.4 Failure to comply. This paragraph shall be modified to specify liability for a fine of not less than $300 but no more than $600.
Geographic limits set forth in certain sections of the 2018 International Fire Code are hereby established as follows:
§ 5704.2.9.6.1 Geographic limits in which the storage of Class I and Class II liquids in aboveground tanks outside of buildings is prohibited in the Township of Tinicum.
§ 5706.2.4.4 Geographic limits in which the storage of Class I and Class II liquids in aboveground tanks is prohibited within the Township of Tinicum.
§ 5806.2 Geographic limits in which the storage of flammable cryogenic fluids in stationary containers is prohibited within the Township of Tinicum.
§ 6104.2 Geographic limits in which the storage of liquefied petroleum gas is restricted for the protection of heavily populated or congested areas is limited within the Township of Tinicum.
A fee schedule for permit, inspection and miscellaneous fees pursuant to the adoption of this article may be established and amended from time to time by resolution of the Board of Commissioners of the Township of Tinicum.
In any case where a provision of this article adopting the 2018 International Fire Code is found to be in conflict with any other provision of the Code of the Township of Tinicum existing on the effective date of this article, the provision which establishes the higher standard for the promotion of the health and safety of the people and property of the Township of Tinicum shall prevail.
