No person shall hereafter carry or possess an open container of beer, wine or spirituous liquor on the streets or other public ways of the Borough of Media; provided, however, that this section shall not be applicable to the carrying or possessing of open containers of beer, wine or spirituous liquors within an area on the streets or other public ways that has been closed by the Borough pursuant to a mass gathering license, issued under Chapter 155 of the Code of the Borough of Media, authorizing the serving of alcoholic beverages within the mass gathering area during the period of time in which such mass gathering is authorized pursuant to such license; and provided, further, that any open containers served by restaurants to customers at outdoor dining tables shall remain at such tables until removed by the restaurant waitstaff and shall not be transported by such customers away from the tables at which such open container were served.
Nothing herein is intended to usurp or restrict control of the sale of liquors by tavern owners as licensed by the Pennsylvania Liquor Control Board, including sales which may be authorized in such open containers by said Pennsylvania Liquor Control Board.
Any person found guilty of violating this chapter shall, upon conviction, pay a fine of not less than $25 nor more than $300, plus the cost of prosecution.
Notice of the adoption of this chapter shall be posted within 30 days of said adoption in conspicuous places in the Borough by the Secretary of the Borough of Media.
