A. The term "Code Official" as stated throughout the book
of codes shall be defined as the Code Enforcement Officer, and the officer
shall be the Borough's Secretary unless the Council, by motion, appoints another
person to be the officer. It shall be said Code Enforcement Officer's duty
to enforce any provisions and regulations of the Media Life Safety Code.
B. Building Inspector. In addition to the Code Enforcement
Officer, the Council may, by motion, appoint the Building Inspector(s). Their
duties shall be to enforce the provisions of this Code, under and at the direction
of the Code Enforcement Officer.
The Zoning Law herein referred to shall be the Media Zone Ordinance
No. 823 in effect and as amended or changed and the date of any application
for any permit hereunder and payment made therefor. Such parts of or sections of the ordinance, which also regulate
in the scope of this article are repealed hereby or, if adopted hereunder,
are hereby made inapplicable; if an ambiguity or conflict arises between the
terms of this article and such Zoning Ordinance, the terms, provisions and
regulations of this article shall repeal and take precedence, unless said
Zoning Ordinance specifically makes any conflicting section of it controlling
over this article.
Permits for life-safety-related work would be included in the building
permit application.

The Code Enforcement Officer, Building Inspector(s) or Fire Marshal
shall not hire or engage the services of any other person without the approval
of Borough Council.

A. Any appeals of the publications of the National Fire Protection
Association entitled "Life Safety Code" adopted under this article will be
heard by the Board originally designed under Ordinance 954. All persons, individuals,
partnerships and corporations shall comply with the Life Safety Code. The
Code Enforcement Officer or Building Inspectors are empowered to enforce the
Life Safety Code. Any violations of the provisions of the Life Safety Code
shall be enforced in accordance with the same procedures/rules of the various
BOCA Code and Property Maintenance Code adopted by the Borough of Media and
the Municipal Planning Code or other appropriate state statutes. If cited
for a Life Safety Code violation, those citations shall be appealed to this
Appeal Board utilizing the same rules, regulations, procedures established
in Ordinance 954 for BOCA violations.
B. The procedures for appeal stated above shall be enforced for
the Life Safety Code, and any of the above listed codes if they are equal
to or exceed the Uniform Construction Codes shall continue in full force and
effect until such time as such provisions fail to equal or exceed the minimum
requirements of the Code, as amended from time to time, and if they were enacted
prior to July 1, 1999. If the requirements of the previous sentence are not
met, then the appeals process for violations shall be through the process
detailed in the Uniform Construction Codes. In the event that the Uniform
Construction Act and/or Code are hereafter repealed or determined to he unconstitutional
or invalid, the various codes which comprise the Code, together with the ordinances
of the Borough of Media that remained in effect as stated in Ordinance 990, shall remain in full force and effect as the codes and procedures
adopted by the Borough of Media.
