The Committee on Planning shall be in charge of the Borough Planning Commission, which shall be constituted as provided in Article
II of this chapter. At the instance of the Committee on Planning and at the request of the Borough Council, the Planning Commission shall perform the functions stated in 53 P.S. § 10209.1.

Pursuant to the provisions of the Act of July
31, 1968, No. 247, 53 P.S. § 10101 et seq., there is hereby
created a Borough Planning Commission consisting of seven persons
to be appointed by Council.

Of the members first appointed, one member of
said Commission shall be appointed for a term of one year, one member
for a term of two years, one member for a term of three years and
two members for a term of four years. Of the two additional members
appointed in 1978, one of the additional members shall be appointed
for a term ending on December 31, 1979, and the other additional member
for a term ending on December 31, 1980. Thereafter the appropriate
number of members shall be appointed annually for a term of four years.
In the event of a vacancy in the Borough Planning
Commission, Council shall make an appointment to fill said vacancy
for the unexpired portion of the term.
All members of said Commission must reside within
the Borough of Conway, and any member who removes from said Borough
shall no longer be entitled to remain a member of said Commission.
All members of said Planning Commission shall
serve without compensation.
The Borough Planning Commission may employ engineers
and other persons, whose salaries and wages and other necessary expenses
of the Commission, where approved by Council, shall be provided for
by a proper appropriation by Council.
The Planning Commission may contract for professional
planning services when approved by Council, and the costs and expenses
of such professional planning services shall be provided for through
proper appropriations by Council.
The Secretary of Council shall furnish to the
Borough Planning Commission a copy of all proposed ordinances and
all amendments thereto relating to the location of any public buildings
of the Borough and to the location, extension, widening or ornamentation
of and parking on any street, boulevard, parkway, park, playground
or other public ground, and to the relocation, vacation, curtailment,
changes of use or any other alteration of the Borough plan with relation
to the same, and to the location of any bridge or tunnel or underground,
surface or elevated railway.
The Planning Commission shall give written approval
or disapproval of any such ordinances, bills or amendments, which
must be communicated to Council in writing within 10 days after the
introduction of said ordinances, but such disapproval shall be advisory
and shall not operate as a vote.
The Borough Planning Commission may have prepared
and present to Council maps of the Borough or any portion thereof,
including territory extending three miles beyond the Borough limits,
showing the streets and highways and other natural and artificial
features and also locations proposed by it for new public buildings,
civic center, streets, parks, playgrounds or other public improvements
or any widening, extension or relocation of the same.
The Planning Commission may make recommendations to Council from time to time concerning any such matters and things referred to in §
27-11 hereof, and in so doing, have regard for the present condition and future needs and growth of the Borough and the disposition of highways and other means of communication.
All plans, plots or replots of lands laid out
in building lots and the street or any portions of the same intended
to be dedicated to public use or for the use of purchasers or owners
of lots located within the Borough limits shall be submitted to the
Borough Planning Commission and approved by it before they shall be
recorded. It shall be unlawful to record such plan in any public office
unless the same shall bear the written approval of the Borough Planning
Commission.
Disapproval of any such plans by the Planning
Commission shall be deemed a refusal of the proposed dedication shown
thereon. The approval of the Commission shall be deemed an acceptance
of the proposed dedication but shall not impose any duty upon the
Borough concerning the maintenance or improvement of any such dedicated
streets, etc., until the proper authority of the Borough shall have
made actual appropriation of the same by entry, use or improvement.
Until the approval of the Planning Commission is obtained, no sewer,
water or gas main or pipes shall be approved or installed within the
area under the jurisdiction of said Planning Commission, nor shall
any permit for connection with or other use of any such improvement
existing be given to any such purchasers or owners.
