It shall be unlawful henceforth for any person or persons to operate in the Borough of Conway any pipes, boilers, engines, containers, tanks or vessels under pressure of air, water, gas or steam, except pipes, containers, tanks or vessels used in the transportation of air, water, gas or steam, hot water tanks used for domestic purposes which are subject to Borough or city water pressure only and steam generators, unless such person or persons hold a permit as hereinafter provided.
All persons desiring to operate any pipe, boiler, engine, container, tank or vessel embraced within the provisions of this chapter shall apply to the Mayor of the Borough of Conway, who shall examine the applicant, and if, after examination, the Mayor is satisfied that the applicant's character, habits of life, ability and experience qualify him as a suitable and safe person to be entrusted with the operation of such apparatus, he shall issue a permit to such applicant to operate pipes, boilers, engines, containers, tanks or vessels embraced within the provisions of this chapter, provided that no person shall be granted such permit unless such person shall have attained the age of 21 years and shall have had at least two years' practical experience.
A. 
Said permit shall entitle the holder thereof to operate for the term of one year said pipes, boilers, engines, containers, tanks or vessels on such premises only as are described in the permit, provided that such permit shall expire on the 31st day of December of the year in which the same is granted; and such permit shall be issued upon the applicant's filing with the Mayor a receipt of the Borough of Conway, evidencing the payment to the Borough by the applicant of the sum of $10, which fee shall be for a permit for one year or fractional part thereof.
B. 
Permits shall be renewed annually without examination by the Mayor, provided said permits are presented for renewal within 10 days after their expiration, and provided further that such application for renewal is accompanied by a renewal fee of $2. The Mayor may for cause shown renew without examination an expired permit up until the end of the month following the month in which the permit expired.
All certificates issued in pursuance of the provisions of this chapter shall be conspicuously posted on the premises wherein the pipes, boilers, engines, containers, tanks or vessels being operated are located.
The Mayor shall investigate all acts of incompetency or misconduct committed by any person to whom a permit has been issued under the provisions of this chapter while acting under the authority of his permit, and if, after investigation, the Mayor shall be satisfied that the person is incompetent or has been guilty of negligence or has endangered life or property or has willfully violated any of the provisions of this chapter, he shall suspend or revoke his permit, as the case may require.
It shall be unlawful for any owner or lessee or any agent of any owner or lessee of any pipes, containers, boilers, engines, tanks or vessels embraced within the provisions of this chapter, or for any person acting for such owner, lessee or agent, to commit in any manner the responsibility of operating any of said pipes, containers, boilers, engines, tanks or vessels to any person other than a person holding a permit issued in accordance with the terms of this chapter, or to permit any person or persons to operate any of said pipes, containers, boilers, engines, tanks or vessels which have not been inspected or for the operation of which a certificate has not been issued in accordance with the terms of this chapter, or which do not meet the requirements of the provisions hereof.

Every person, including the agent, employee, officer or member of any firm or corporation, operating or permitting to be operated in violation of the terms or provisions of this chapter any pipes, boilers, engines, containers, tanks or vessels under pressure of air, water, gas or steam, except pipes, boilers, engines, containers, tanks or vessels used in the transportation of air, water, gas or steam, hot water tanks used for domestic purposes which are subject to Borough or city water pressure only and steam generators, shall, upon conviction thereof before any District Magistrate, be fined not more than $300 for each offense or be committed to Beaver County Jail for a period not exceeding 30 days, or both. Each day in which any pipe, boiler, engine, tank or vessel embraced within the terms of this chapter shall be operated in violation of the terms hereof shall constitute a separate and distinct offense.
