WHEREAS, the orderly conduct of the business of the Municipal Court of the Town of West New York requires that the Town have a Municipal Court Prosecutor,
The Commissioners of the Town of West New York, Hudson County, New Jersey, ordain, as follows:
The position of Municipal Court Prosecutor for the Town of West New York is hereby created.
The Municipal Court Prosecutor shall be appointed by the Director of Public Affairs for a term of one year and until his successor is appointed and qualified.
The Municipal Court Prosecutor shall prosecute, on behalf of the state or the Town of West New York, as the case may be, in the Municipal Court of the Town of West New York, defendants charged with violations of the laws of the State of New Jersey or ordinances of the Town of West New York whom the Judge of the Municipal Court of the Town of West New York requests or directs that he so prosecute. The Municipal Court Prosecutor shall also represent the state or the Town of West New York, as the case may be, in appeals by defendants convicted in the Municipal Court of the Town of West New York of violations of ordinances of the Town of West New York and shall perform such other duties on behalf of the state or the Town of West New York as provided by law or the rules governing the courts of the State of New Jersey.
The Municipal Court Prosecutor shall also prosecute all charges of violations of the alcoholic beverage laws preferred before the Board of Commissioners and shall also represent the Town of West New York in appeals by licensees to the Division of Alcoholic Beverage Control or to the courts of the State of New Jersey.
The Municipal Court Prosecutor shall be an attorney at law of the State of New Jersey.
The Municipal Court Prosecutor shall receive an annual salary as set forth in the Salary Ordinance[1] to be paid in the same manner as the salaries of other municipal employees are paid.
