A. 
A person, firm or entity may only engage in construction between the hours of 7:00 a.m. and 6:00 p.m. on Monday through Friday, and Saturday between 7:00 a.m. and 4:00 p.m. Construction shall be prohibited at all times on Sunday.
B. 
Notwithstanding the provisions of Subsection A above, upon a showing of emergent need, the Commissioner under whom Code enforcement falls may recommend to the Board of Commissioners to grant permission and/or approval to engage in construction on weekdays, Saturdays and Sundays at times differing than those set forth therein. Board of Commissioners permission and/or approval shall be provided by resolution.
Any person, firm or entity who shall engage in construction during those hours shall be in violation of this chapter and shall be subject to the issuance of a summons to be issued by the Construction Code Official and/or the Police Department returnable in the Municipal Court of West New York.
Any person violating any provision of this article shall be subject to a payment of a fine not to exceed $500 and, for a second or repeated offense, a minimum fine of $500 and a maximum fine of $1,000 for each separate offense.
