The following terms used in this article shall mean and include:
COMBUSTIBLE WASTE
Yard trimmings, rags, waste wood or cardboard and other combustible waste solids of a nonvolatile or explosive nature.
GARBAGE
Animal and/or vegetable waste solids resulting from the handling, preparation, cooking and/or consumption of foods.
NONCOMBUSTIBLE WASTE
All solid waste material which does not bum.
REFUSE
Garbage, combustible and/or noncombustible waste solids.
A. 
The owner, agent, lessee, tenant or occupant of every dwelling or other premises where refuse accumulates shall provide and keep on such premises sufficient and suitable receptacles, with tight-fitting covers, for receiving and holding the aforesaid refuse.
(1) 
"Sufficient" is defined for the purpose of this section to be at least one receptacle for each family unit or other occupant of premises and at least two such receptacles for each restaurant, market, store or similar business establishment where the aforesaid refuse shall accumulate.
(2) 
"Suitable" is defined for the purpose of this section to be a watertight metal receptacle with a closely fitted cover so constructed as to prevent spilling or leakage of its contents. Such receptacles shall have not more than 30 gallons' capacity.
(3) 
No person shall place out for collection any garbage in bags, boxes or corrugated receptacles; all pasteboard or corrugated boxes and paper when placed out for collection shall be collapsed and securely tied.
B. 
Receptacles that are badly broken or otherwise fail to meet the requirements of this section may be classed as refuse and collected and disposed of as such by the person or agency responsible for the collection of refuse. The Sanitary Inspector shall determine whether the said receptacles are badly broken or otherwise fail to meet the requirements of this section.
C. 
Receptacles of refuse shall not be set out for collection, except during hours of the day or days scheduled for collection of refuse, or the evening before, and not before 8:00 p.m. of said evening.
D. 
Receptacles shall be conveniently located on the premises for the storage of refuse and maintained in such a manner as to prevent the creation of a nuisance or a menace to public health.
E. 
All refuse, garbage, combustible waste and noncombustible waste picked up from any commercial enterprise by a private entity engaged in the business of collecting and removing garbage from commercial enterprises shall be completed on the day scheduled for pickup between the hours of 12:00 midnight to 7:00 a.m.

F. 
Every collector and salvager of refuse material shall conform to the ordinances of the Town of West New York and the provisions of this chapter. Any person who engages in the business of collecting and removing garbage or other refuse who shall cause any refuse to spill from its original container shall be responsible for immediately cleaning up said spillage.

A. 
Garbage shall be thoroughly and completely drained of all liquids, wrapped securely in paper and placed in receptacles as described in § 348-7.
B. 
Paper shall be secured and properly tied into bundles or other packages in a manner to prevent any scattering while awaiting or during collection. The bundles or packages shall be of a size and weight to permit ease of handling by one man.
C. 
Waste or drained oil waste properly contained may be disposed of in metal containers. No combustible oils are to be considered as refuse.
D. 
Combustible or noncombustible waste of such a nature that it cannot be deposited in a receptacle shall be securely and properly tied into bundles or packages to prevent spilling or scattering. The bundles or packages shall be of a size and weight to permit ease of handling by one man.
E. 
Refuse prepared for collection shall be packaged or otherwise assembled in quantities weighing not more than 75 pounds.
F. 
Every owner, tenant, lessee, occupant or person in charge of such building shall cause to be put into their respective receptacles all such materials and substances; but no such receptacles shall be filled to a greater height than a line within such receptacle four inches from the top thereof; nor shall any such receptacle, when so filled, contain more than 75 pounds; and every receptacle shall be kept at all times in a condition satisfactory to the Department of Public Works or the Department of Health.
G. 
Such receptacle shall be kept within the building, or in the rear or side premises therewith connected, until the time for the removal of such substances, when such receptacles shall be placed at the sidewalk curb in front of such building; all receptacles shall remain so placed until the contents thereof shall have been removed by the designated garbage collection agency, immediately after which such receptacles shall be returned to such building, or to the rear or side premises therewith connected; and during this period, every garbage, refuse or liquid waste receptacle shall be kept at all times covered with a tight-fitting metal cover.
H. 
No such receptacle or refuse or rubbish shall, however, be so placed as to constitute or contribute to the creation of a nuisance.
I. 
No receptacle shall be placed within 10 feet of either side of a fire hydrant.
J. 
Receptacles for ashes, garbage and liquid substances are not to be interfered with or their contents disturbed. No person, not for that purpose authorized, shall interfere with the receptacles for ashes, garbage or liquid substances, or with the contents thereof; nor shall any person in any way handle or disturb such contents.
No person shall engage in the business of collecting and removing garbage or other refuse without first obtaining from the Department of Health a license to engage in and carry on such business. All vehicles or conveyances to be used in said business shall be approved by the Department of Health before being used, and shall at all times thereafter be subject to inspection by this Department. The fee for a license to engage in any such business shall be $25 per year, all licenses expiring on December 31 of the year of issuance.
The storage, collection or disposal of refuse in violation of any provision of § 348-7 or 348-8 of this article is hereby declared to be a nuisance and detrimental to public health.

Any person who violates any provision of, or order promulgated under this article shall, upon conviction thereof, be liable to a penalty as provided for in Chapter 1, General Provisions, Article I.
